H. Whatley I W.H. Whatley do make declare and publish this my last will and testament hereby revoking all former wills heretofore made by me. Item 1st I will that after my death all my just debts be paid. Item 2nd I will and desire upon my death all my property of what kind so ever be kept together and managed by Executor hereafter named for the benefit of my beloved wife Lydia J. Whatley and our child Francis Bartow in such manner as my Executor may deem best with power when it shall manifestly appear to their interest to sell any portion of the same without the expense of an order of Court. That my child receives from the proceeds of my estate an education and such other expenses as may be necessary in his raising and that the property be so kept together and managed until my said son arrives of age or until my wife should marry and then or in that event my whole estate to be equally divided between my said wife and child should we have another or other children then the division to be equal among the children and their mother. Should a division become necessary in consequence of the marriage of my wife or the arriving of age of my child the same to be made by decent and proper citizens appointed for that purpose and hereby desire that my Executor be and he is hereby entitled to manage my estate without the trouble and expense of making regular annual returns but the same in every respect to be managed for the benefit of my said wife and child and other child or children should such be born, and each child hereafter born to receive an equal part with its mother and the other child or children. I hereby appoint Thos. J. Bussey my Executor to carry out this my will and desire that he resume the responsibility of the same and in every respect to manage my estate in such manner as seems to him proper and right and for the benefit and advantage of my wife and child. Green December Term 1862 Pike Court of Ordinary Came in open court Hartford Green and Levi Elliot and being duly sworn depose and say that they saw Wm. H. Whatley sign and seal and heard him publish and declare the within as his last will and testament that he was of sound and disposing mind and memory at the time that they witnessed the same for him at his request and in his presence and in the presence of each other and the other Subscribing witnesses and that the same was executed by him freely and voluntarily on the day it purports to be. Hartford Green Levi Elliot Sworn to and subscribed before me in open court this 8th day of Dec. 1862 Z. Sims Ordinary Georgia Pike County I do solemnly swear that this writing contains the last will of within named Wm. H. Whatley deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charge me and that I will make a true and perfect Inventory of all such goods and chattels so help me God Thos.
