Marshall of the County and State before mentioned being in a low stste of Disease and may shortly depart this life, deem it just and proper both as respects my family and myself, that I should make a disposition of the property with which a kind Providence has blessed me, do therefore make this my last will and testament hereby revoking all others heretofore made by me. Item 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life. 2nd Item I desire and direct that all my just debts be paid. 3rd Item I desire and direct that all my property both real and personal remain in possession of my beloved wife Nancy until(?) my youngest children are raised and after _?_ this an equal division of all my property except a home for my wife Nancy during her natural life and after her death the land to be equally divided between my heirs. Should my family wish to remove that my executors should sell the before said land and settle somewhere else that my wife Nancy might choose. 4th Item I desire and direct that my children all receive an equal portion with those that have received before this time. 5th Item I hereby constitute and appoint my beloved wife Nancy Executrix and my worthy friend Charles F. Redding Executor of this my last will and testament this March 28th 1837. Pendleton J. Marshall (his mark) Made on the day of his eyes being closed Signed sealed declared and published by Pendleton J. Marshall as his last will and testament in the presence of us the subscribers who subscribed our names hereto in the presence of said Testator and of each other this March 28th 1837. James P. Lifsey and Benjamin Lifsey the subscribing witnesses to the within will and testament of Pendleton J. Marshall deceased do solemnly swear that we saw Pendleton J. Marshall sign seal and heard him publish and declare this writing to be and contain his last will and testament. At the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and belief. And we do further swear that we signed the same by the request of the Testator and in his presence and in the presence of each other. James P. Mangham John W. Mangham Joseph S. Beckham Ordinary Georgia Pike County I Nancy Marshall do solemnly swear that this writing contains the true last will and testament of Pendleton J. Marshall deceased as far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges me, and that I will make a true and perfect inventory of all such goods and chattels so help me God.
