Item 1st It is my desire that after my death to be decently buried. Item 2 It is my wish and desire that if I should have any outstanding debts against me at the time of my decease that a sufficiency of my estate or effects be sold to pay up all my debts if necessary. Item 3rd I give bequeath and devise to my beloved wife Mary Fincher with whom I have lived for about thirty years and my youngest son Jonathan W. Fincher all of my estate both real and personal after the payment of my just debts equally share and share alike to be divided when he my said son Jonathan W. Fincher arrives at the age of twenty one years or at the marriage of my wife Mary if she should do so after my death my said son to receive an education out of said estate. Item 4th My other children towit my beloved daughter Bendy(?) T. Story, Bathia(?) Mapp wife of William Mapp, my beloved son Joseph T. Fincher and beloved daughter Louisa Cartis(?) wife of Thomas M. Cartis(?) I give and bequeath nothing, as I have heretofore given each and every of my children named in this item of my will property equivalent to that I have given my beloved wife and son Jonathan W. in the third item of this my will and my will and desire is to do for each and all alike. Item 5 I hereby constitute and appoint my beloved wife Mary Fincher Executrix and my beloved son Joseph T. Fincher Executor of this my last will and testament this 22nd June 1854. Joseph Fincher Signed sealed declared and published by Joseph Fincher as his last will and testament in the presence of us the subscribers who subscribed our names hereto in the presence of said Testator at his special instance and request and of each other this 22 day of June 1854 Wiley E. Mangham William Barrett Jr. W.P. Tyler State of Georgia Pike County We Wiley E. Mangham Wm. P. Tyler and William Barrett Jr. the three subscribing witnesses to the within will do solemnly swear that we saw Joseph Fincher sign seal and heard him publish and declare this writing to be and contain his will and at the time thereof he was of sound disposing mind and memory that he did it freely without compulsion to the best of our knowledge and belief. Fincher do solemnly swear that this writing contains the true last will and testament of Joseph Fincher deceased so far as we know and that we will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges us and that we will make a true and proper inventory of all such goods and chattels so help us God.
