Parks of said County. I Samuel C. Parks of the County and State aforesaid being of sound and disposing mind and memory do make publish and declare the following writing to contain my last Will and Testament. Item 1st It is my will and desire that after my death all my just debts be paid. Item 2nd I will and bequeath to my beloved wife Caroline Parks during her natural life or widowhood the use of my dwelling and out houses, garden and orchards, and the Coggin field, and the field west of the Coggin field, and two little fields by the Gin house and timber for repairs and firewood, one choice horse or mule, buggy, two cows and calves, ten stock hogs and a sufficiency of provisions for her own use and to feed her stock for twelve months and the household and kitchen furniture or so much thereof as she may desire except the piano which I give to my daughter Ann Allen. Item 3rd I give and bequeath to my son Walter S. Parks and Ann H. Allen wife of John C. Allen all the remainder of my stock of every description after the above bequests and the payment of my just debts if any, and all my lands in Said county containing six hundred and seventy acres with the exception of the life time or widowhood bequest to my wife mentioned in the 2nd item of this will and upon her marriage or death then the whole estate in said lands to go to and belong to my said Son Walter S. and my Said daughter Ann H., and I further more give and bequeath the whole of the remainder of my property to my said son Walter S. and daughter Ann H. having heretofore given as advance merits to my other children the whole amount I desire that them to have out of my estate. Item 4th It is my will and desire that John C. Allen act as trustee for my son Walter S. Parks no consequence of the incapability of the said Walter S. Parks to manage the same and what all the property willed to my said son Walter S. by this writing go into the hands of said John C. Allen as trustee for the said Walter S. and that he hold and manage the same as trustee aforesaid for the benefit of the said Walter S. during his life and upon his death the whole of said property to go and belong to my said daughter Ann H. and that the same be paid over to her by the said John C. Allen Trustee as aforesaid. Item 5th It is my desire that my son in law John C. Allen qualify as Executor of this my will and and that he carry the same out according to the provisions hereof. In witness here of the said Samuel C. Parks has hereunto set his hand and seal this the 17th day of February 1868. Samuel C. Parks We the undernamed swear it, we saw Samuel C. Parks sign and seal and heard him publish and declare the foregoing to contain his last will and testament and that we at his request sign the same as witnesses. February 17th 1868. J.L.G. Parks being produced in open Court for probate by the executor who has filed his petition to prove the same and the witnesses to said will H. Green and Jas. L.G. Caldwell having subscribed the following affidavit endorsed as said will January Term 1869 of Pike County Court of Ordinary. Came in open court at this regular term of the court H. Green, J.L.G. Caldwell and being duly sworn depose that they saw Samuel C. Parks sign and publish the within as his last will and testament while of sound and disposing mind that they witnessed the same for him at his request and in his presence and of each other, and that the same was executed voluntarily by him on the day it purports to have been executed. Sworn to and subscribed in open court J.J. Hooper(?) Ordinary Hartford Green Jas L.G. Caldwell Georgia Pike County Pike Court of Ordinary Jan. Term 1869 I do solemnly swear that this writing contains the true and last will of the within named Samuel C. Parks deceased so far as I know or believe and that I will well and truly execute the same in accordance with the laws of this State so help me God. John C.
