I William Ward of Pike County in the State of Georgia do make and ordain this as my last will and testament this 28th day of April 1835 being in a reasonable state of health and memory - in the first place I recommend my soul to Almighty God who gave it nothing doubting but I shall receive the same again at the general resurrection when the secrets of all hearts must be made known and every one receive their just rewards according to the deeds done in the body, as for my estate real and personally to be divided among my legates as will be undernamed in the first place. My will is that all my just debts and contracts be promptly paid and discharged and if any one of the legatees is dissatisfied with this my last will and testament and should try to break my will or discredit my design in this my will, then that legatee shall have his or her part reduced to ten dollars and they shall have no more and this my last will and testament shall stand firm and unmolested according to the true intent and meaning of the same and I give to my son William Washington and Thomas Sumter my sons a lot and half of land to be equally divided between them as it can and I give to my son William Washington the molatter (sp) girl by the name of Pheby and I give him my bedsted (sp) and furniture that I lye (sp) on and I also give him one sow, the sow that his grandfather howard (sp) give to him for him to have and her and her increase and I also give him one cow and calf to be charged out of the stock by his mother. The reason why I give my son William Washington his part of is to keep a home for my wife Martha that she may not be put to any outlay (?) for a home when I was going to the earth to return to it no more my will is that my son William Washington shall have the land whereon the plantation is and if my wife Martha should marry before my children should come of age to wait themselves then the plantation should be rented out and the rent of the land to be put out upon interest for the use of my sons and to be equally divided between them for there (sp) education and if my son Thomas Sumter part of the land when it is appraised does not come to as much as the other legatees part then for it to be made up out of my estate equal with the rest of the legatees and my wife Martha to have one seventh part of my estate the balance of it to her own use and also give the loom and gears belonging to it and wheel and card to her own and also her part of the estate and I also give unto my daughter Viley Blackmon, Mary Hill, Sarah Reddin, Elizabeth Blackmon, Nancy Baskin each one seventh part of my estate equal among them all as my legatees of this my last will and testament and concerning a Bond that my Nephew James Osburn give (sp) to Aron Houston in the sum of one thousand pounds North Carolina money and I called (?) in the Bond as security for the delivery of the property and when I was going to move to ------ my Nephew offered to deliver up the property on my account and Houston would not except the property when offered to him for which reason I do disavail (?) the Bond and do not consider myself any way bound to discharge that obligation - if there is anything to pay let James Osburn pay it as he had the benefit of the property and Houston would not receive the property when tendered to him let him look elsewhere for a remedy and I do hereby appoint my ----- friends William White and James Riggins as my executors of this my last will and testament to see to my concerns when I am going to my last home and cannot see to it myself any more and I do hereby revoke and disannul all former wills and testaments by me made and do hereby acknowledge this as my last will and testament the day and date above written. Kitchens swear that we saw William Ward sign seal publish and declare this writing to be and contain his last will and testament. That at the time thereof he was of sound disposing mind and memory. And that he did it freely. without compulsion to the best of our knowledge so help us God. Jas M Hill John Hill James R. White do solemnly swear that this writing contains the true last will of the within named William Ward deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto attend and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels.
