For the natural love & affection I have to my beloved wife Elizabeth Marshall as well as to provide for the temporal comfort of her & my beloved children; It is my will & desire that all my estate real personal & mixed should be kept together, unsold and undivided solely under the care direction & superintendence of my beloved wife & Son Stephen Wright Marshall, To be by them conducted in such manner as they may deem best for the interest of my estate & children, until the death of my beloved wife Elizabeth, Subject however to the following directives, (to wit) So soon as my debts are paid & the necessary wants of my other family are provided for , It is my will & desire that my beloved daughter Martha Caroline Allen shall receive the sum of five hundred dollars, It being the sum I wish & desire all my other children (Pendleton Jones Marshall) excepted to have soon as they respectively reach the age of twenty one years or shall marry, For the natural love & affection I bear to my beloved son Pendleton Jones Marshall I will and bequeath unto him the following tracts of land to wit- Lot No. one hundred & forty in the sixteenth district of Irwin County when surveyed containing five hundred & ninety acres, Also lot No. eight hundred & sixty three in the fourth district of the first section of Cherokee when surveyed which lots with what I have already given him is all I intend or devise he shall have or receive of my estate now or hereafter It is my further will & desire [?devise] that should my beloved wife live to see my youngest child if lawful age & and should think proper that she may then cause my remaining estate to be equally divided among my beloved children of her body, should she not think proper to do so then it is my wifes desire the same should be done at her death by sale division or [-----] as will best comport with equal justice to each of beloved children of her body- For the love affection & confidence I bear towards & have in my beloved wife Elizabeth MArshall and son Stephen Wright Marshall I hereby nominate them my executrix & executor to execute this my last will & testament. In testimony whereof I have hereunto set my hand & affixed my seal this 15 of Feb 1839 John Marshall In presence of Charles McDowell Robert Allen Henry Stokes Georgia Pike County Court of Ordinary May Term 1839 The last will & testament of John Marshall having been duly proven at this regular term in open court, upon the oaths of Charles McDowell Robert Allen & Henry Stokes ordered that the same be admitted to record Georgia Pike County I Elizabeth Marshall do solemnly swear that this writing contains the true last will & testament of the within named John Marshall deceased so far as I know or believe & that I will well & truly execute the same by paying first the the debts & then the legacies contained in said will as far as his goods & chattels will thereto extend & the law charge me & that I will make a true & perfect inventory of all such goods and chattels, so help me God.
