All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Bill Russell dragonraj@comcast.net August 2, 2004, 9:26 am Source: Will Book B P. 66-68 Pike County Probate Court Written: September 7 1838 Recorded: November 1838 Will of James Patton 27th Nov. 1838 Georgia Pike County In the name of God Amen I James Patton of the County & State aforesaid, being infirm of body but of sound mind & memory, do make this my last will & testament, to wit Item 1st After paying all my just debts, I give & bequeath the whole of my estate, whether real or personal & and everything that I am possessed of to my beloved wife Elizabeth Patton during her natural lifetime, or widowhood, & at her death to be equally divided among all my children, and should my said wife marry again then the whole estate is to be equally divided between my said wife & all my children, so that each ones part or portion shall be equal at that time Item 2nd And my further will, design & desire is that in consideration of my giving to my said wife Elizabeth Patton all my estate both real and personal & every thing that I am possessed of is that she my said wife is, out of the proceeds of the above property to educate & maintain all my said children until they arrive to the age of twenty one years, or marries; so that their portion of my said estate shall not at her my said wifes marrying again be made chargeable for their my said childrens education & maintenance while minors Item 3rd Lastly I do hereby appoint my beloved wife Elizabeth Patton sole executrix of this my last will and testament. In witness whereof I do hereunto set my hand and seal, this seventh day of September eighteen hundred & thirty eight James Patton Joseph (his mark) Deason [?] David Smith Isaac B.
