I James Lowery of the county & State aforesaid being infirm in body, but of sound mind & memory do make & ordain this my last will & testament in manner following (viz) Item 1st after paying all my just debts I wish the whole of my estate both real & personal & everything that I am or may be possessed of, sold at such a time& on such a credit as may be best for the interest of my representatives ( which is to be left entirely with my hereinafter named executor) and the amount to be equally divided among the following Legates to wit, when they shall arrive to the age of twenty one or so soon thereafter, as he the said executor can realize the amount of said sale, to wit, my wife Frances Lowery; my son in law William Deason; my son Asa Lowery, my son David Lowery, my daughter Frances Lowery & my daughter Peggy Lowery Item 2nd I hereby exposing[?] especial trust and confidence in my friend John Farley[?] of the county & State aforesaid do appoint him the said John Farley my executor of this my last will and testament, and at the same time I do hereby ordain & appoint the said John Farley Testamental Guardian, both of the estates as well as of the persons of my son Aza Lowery, my son Lewis Lowery & my daughter Peggy Lowery till they arrive at the age of twenty one years. Item 3rd Having during my lifetime given unto my Son in Law William Deason property to the amount of forty eight dollars, my will & desire is that that amount be deducted from his distributive share & equally divided among the rest of the legates & himself so as to make each ones part either as received or to be received equal Item 4th As it may happen, that my Executor John Farley may from wanting to remove, wish to be discharged from his executor & Guardianship herein given, I do hereby give to him by & with the consent of my son Asa Lowery, my son Lewis Lowery & my daughter Peggy Lowery or such of them as may be under him as Guardian at that time, to appoint a Guardian for them & their effects who shall be executor of this my last will and testament in his [----] & stead, which appointment I hereby ratify & allow, as fully & effectually as if directly made by me. In witness whereof I the said James Lowery have hereunto set my hand & seal this day & date first above written.
