Simmons of Said State and County being of advanced age and knowing that I must shortly depart this life deem it right and proper both as respects myself and family that I should make disposition of the property which a kind providence has given me. I do therefore make this my last will and Testament hereby revoking all others heretofore made by me Item 1st I desire and direct that my body be buried in a decent and Christian manner Suitable to my condition and circumstances in life by my Executor hereinafter named and appointed. My Soul I Trust will return to rest with God who gave it - as I trust - and hope for Salvation through the merits of the blessed Lord and Savior Jesus Christ in whom I have belived [sp] for more than forty years Item 2 I desire and direct that all my just debts be paid without any unnecessary delay by my Executors Item 3rd I will and direct that all of my Estate both real and personal remain with my wife Elizabeth Simmons for her benefit and under her control during her natural life Item 4 I give and bequeath to my Grand Son at the death of my wife Jas. W. L. Simmons Son of my Son James Simmons one twelfth of my Estate after my debts are paid Item 5 I will and bequeath to my wife Elizabeth Simmons one Equal Share of my Estate Subject to any disposition She may choose to make of it and the remainder to be Equally divided among my children or their legal representatives Item 6 I do hereby constitute and appoint my Son William H. Simmons & my Son in Law Thos G. Hunt my Executors of this my last will and Testament Signed, sealed, and published by William H. Simmons as his Last Will and Testament - in the presence of us who subscribed our names as witnessess in the presence and at the request of the said testator & in the presence of Each other this 9th day April 1866 Test - Abraham S. Allen Edward N. Huckaby William H. Simmons George (his mark) Donahos The Court of Ordinary June Term 1866 The Will of W. H. Simmons being produced in open Court to be proven and the witnesses to the Said will came in open court - at this Regular Term of Court A. S. Allen, Edward N. Huckaby & George Donahoe & being duly Sworn deposeth and sayeth that they Saw W. H. Simmons sign and publish the within as his last will and Testament - while of sound and disposing mind that they witnessed the same for him at his request and in his presence and in the presence of each other and that the Same was Executed voluntarily by him on the day it purports to have been Executed A.
