All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net September 19, 2006, 4:14 pm Source: Will Book C Pike County Probate Court Written: December 3, 1849 Recorded: January 14, 1850 Georgia Pike County In the name of God Amen I Joseph Hale of the State and County aforesaid being of advancing age and infirm in body and knowing that I must sooner or later depart from this world, deem it right and proper both as respects myself and my family that I should make some arrangement with what little property a kind providence has blessed me with - I therefore make this my last will and testament Item 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition my soul I trust will return to God who gave it as I hope for eternal salvation in and through the merits of the Lord Jesus Christ Item 2nd I desire and direct that all my just debts be paid as soon as it can be practicably done without injury to my property or family Item 3rd It is my will and desire that all my lands, notes, bonds , household and kitchen furniture, horses, hogs and cattle and in fact all my Estate both real and personal be left in the hands of my beloved wife Lincey Hale during her widowhood or lifetime that she have full power and control of the same to manage for the good of the family to sell such things as they may have to sell and to buy such things as the family may want or their circumstance actually require - and it is further my desire that if it should appear best for the benefit of my wife and children that the present lands I own to be sold that my beloved wife Lincey should sell them and I do hereby give her full power to do so and make titles to the same. Item 4th It is further my desire that if any of my daughters now single should marry that my wife Lincey Hale give them their Bed and bed clothing so as to make it equal to the amount my daughter Nancy Smith had given her when she Married Item 5th It is my will and desire should my wife Marry or not at her death that all the property she is then possessed of be legally sold and equally divided amongst my beloved children Margaret A. Hale, Mary Jane Hale, Joseph T. Hale, Nancy O. Hale now the wife of John Smith, Lucy M. Hale Lincey T. Hale, Martha E. Hale and David M. Hale., with the exception of David M. Hale who is now small about five years old it is my will and desire that he shall receive three hundred Dollars extra to the amount the rest of my children received for the purpose of raising him and giving him some education Item 6th I constitute and appoint my beloved wife Lincey Hale Executrix to this my last will and Testament this December 3rd 1849 Joseph Hale his mark Signed sealed declared and published by Joseph Hale as his last will and Testament in the presence of the subscribers who subscribed our names hereto in the presence of said Testator and of each other this 3rd December 1849 John Smith William Perkins David M. Bloodworth Georgia Pike County We David M. Bloodworth and William Perkins do solemnly swear that we saw Joseph Hale (by making his mark) sign Seal publish and declare this writing to be and contain his will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and that we saw John Smith sign the same as witness. Maugham CCO Georgia Pike County I Lincey Hale do solemnly swear that this writing contains the true last will and Testament of Joseph Hale deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges me and that I will make a true and perfect inventory of all such goods and chattels so help me God.
