I James M. Hightower being of advanced years and in feeble health but of sound mind and memory deeming it right and proper to dispose of the effects a kind Providence has blessed me do make this my last will and testament hereby revoking all others heretofore made by me. Item 1st I desire my body buried in a decent Christian manner my soul I commend to God through the merits of the Lord Jesus Christ Item 2nd I direct my Executor hereinafter appointed to pay all my just debts with as little delay as possible in justice to all [ _ ] Item 3rd I give, bequeath and devise to my daughter Caroline E. Hightower and her children, my house and lot with all the rights , members and appurtenances to the same in any manner belonging; the same being the lot I now live in the town of Barnesville together with all my household and kitchen furniture of every kind. Item 4th I give to my two daughters Martha J. Hunt and Emma P. Peacock, and their children two lots of land Nos. Thirty six and thirty seven lying, being and situated in the tenth district of Upson County, GA. With all the rights members and appurtenances to the same in any way belonging the same to be divided to suit themselves Item 5th The residue of my Estate both real and personal Bonds notes accounts or other evidences of debt and all the effects whatever & whenever after complying with item 2nd give bequeath and devise to my children equally to wit: Sarah F. Andrews Charnel C. Hightower Daniel A. Hightower James C. Hightower. I have recently given my son John L. [?] Hightower one lot of land worth one thousand dollars and five hundred dollars in cash which will make equal with my other children. I hereby order my Executor to withhold from my son James C. Hightower his legacy until he settles the demands my estate hold against him Item 6th I constitute and appoint my son Charnel C. Hightower Executor of this my last will and testament hereby authorizing and requiring him after my decease to wind [?] my estate and fairly and equably settle my debts and divide my effects as herein provided with as little delay as possible. In witness whereof I have thereunto set my hand and seal this first day of March 1869 James M. Hightower his mark Signed sealed declared and published by James M. Hightower as his last will and testament in presence of the undersigning who subscribed the same in his presence at his instance and request and in the presence of each other H. H. Swatts Chas. E. Lambdin A. Morrill Lambdin Pike Court of Ordinary December Term 1869 The Will of James M. Hightower being produced in open court for probate by the Executor who has filed his petition to prove the same and the witnesses to said will H. H. Swatts and A. Morrill Lambdin having subscribed the following affidavit endorsed on said will Dec. Term 1869 of Pike Court of Ordinary came in open court at this Term of the court and being sworn depose that they saw James M. Hightower sign and publish the within as his last will and testament while of and disposing mind, That they witnessed the same for him at his request and in his presence and of each other and that the same was Executed voluntarily by him on the day it purports to have been Executed.
