Howe of said State and County being in feeble health but of sound and disposing mind and memory deem it right and proper that I should make a disposition of the property with which a kind Providence has blessed me I do therefore make this my last Will and Testament hereby revoking all others heretofore made by me. Item 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life. Item 2nd I desire and direct that all my just debts be paid by my executors hereinafter named, as soon as they are due or as soon thereafter as proper arrangements can be made to settle them. Item 3rd I desire and direct that my beloved wife Lucinda R. Howe shall take charge of all my Estate both real and personal and that the same shall by her kept together and managed as by her should be deemed best for the same, for the maintenance [ and education marked out ] of herself and for the maintenance and education of my minor children until they shall arrive at the age of maturity or majority. Item 4th I desire and direct that upon the marriage of my beloved wife Lucinda R. Howe after my death that all my Estate both real and personal shall be by my Executors hereinafter named equally among my heirs at law share and share alike: my personal Estate to be sold for division , and my real estate to be either sold and the proceeds of the sale distributed among my heirs or the same to be divided in kind as shall be deemed best for my executors. Item 5th I desire and direct that all my estate upon the death of my beloved wife Lucinda R. Howe if not distributed before that time as hereinbefore provided shall be by my executors distributed by my according to the fourth Item of this Will Item 6th I desire and direct that if it shall become necessary for any of my property to be sold for the purpose of paying any of my outstanding debts that the two store houses and lots in the town of Milner now occupied by Manny and Brawner and J. P. Hunt be sold for that purpose unless my wife Lucinda R. Howe shall deem it better to sell some other property in which event I hereby empower her to exercise her discretion in the matter. Item 6th [ 7th] I hereby nominate my son William R. Howe and my son in law, Marion [?] Green executors of this my last will and Testament this August 11th 1873 W. J. Brown Signed sealed declared and published by William J. Howe as his last will and testament in the presence of us the subscribers who subscribed our names hereto in the presence of each other and in the presence of the testator at his special instance and request this August 11th 1873 J. A. Hunt Geo. A. Gardner Jno. P. Hunt Pike Court of Ordinary November Term 1873 Came into open court John P. Hunt and George A. Gardner two of the subscribing witnesses being duly sworn depose and say that William J. Howe signed and sealed the foregoing instrument in their presence and that they heard him declare the same to contain his Will and Testament that he signed the same freely and voluntarily and that he was of sound and disposing mind and memory at the time that they signed the same at his request as witnesses in his presence and in the presence of each other on the day it purports to be Jno. Green do solemnly swear that this writing contains the true last Will and Testament of William J. Howe deceased so far as we know or believe and that you will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charges you and that you will make a true and perfect inventory of all such goods and chattels so help you God W.
