I J. H. Howell of the County and state aforesaid being of sound mind and disposing memory do make, constitute and ordain this to be my last will and testament. It is my desire that all of my just debts be payed [sp] . After the payment of my just debts an aforesaid it is my will and desire that all my property of whatever kind I may be possessed of either real or personal shall belong to my beloved wife Sallie E. [?] Howell for and during her life and after her death to be equally divided between my two children Willie and Annie. It is my desire that my wife Sallie E. Howell and W. D. Howell be executors to this my last will and testament and that they have the full power to execute the same without orders from Court and that they be relieved from making Bond and returns. Witness my hand and seal this 28th day of August 1897 James H. Howell Signed, declared and published by the said J. H. Howell in his last will and testament in the presence of us the undersigned who subscribe our names in his presence at his request and in the presence of each other. This Aug. 28th 1897 E. F. Dupree J. B. Mathews J. J. Howard We solemnly swear that this writing contains the true last will and testament of the within named J. H. Howell deceased so far as we know or believe and that we will execute the same in accordance with the laws of the state So help us God. W. D. Howell Nov. 6th 1911 J. W. [?] Means Ord. Georgia Pike County To the Hon. J. W. Means Ord. Of said Co. The petition of W. D. Howell a resident of said County and nominated executor of the last will of J. H. Howell also a resident of said County who died on the 24th day of Oct. 1911 owning valuable real and personal estate in said state disposed of by said will amounting to the sum of about five thousand dollars and which remains to be administered, respectfully showth [sp] that said J. H. Howell died testate , that his will is hereby presented for probate at the regular term of Court of Ordianry of said county in common form; that your petition is named in said will as one of its executors. Wherefore you petition prays leave to prove said will in common form and the issuing to him of letters testamentary upon them taking the oath of office Oct 30th 1911 W. D. Howell Georgia Pike County Before me came E. F. Dupree named as a witness to the within writing purporting to be J. H. Howell’s last will and being duly sworn saith that he with J. J. Howard and J. B. Mathews at the request of J. H. Howell and in his presence and in presence of each other, did attest as witnesses the within writing as J. H. Howell’s will; that the same was signed and published by J. H. Howell in their presence as his last will; that he was at the time of said attestation and signing by him of sound and disposing mind and memory; that he executed the within paper voluntarily . E. F.
