Johnston I Catherine M. Johnston of said State and County being of sound and disposing Mind and Memory do make this my last Will and Testament hereby revoking all Wills heretofore made by me. Item 1st It is my Will that all the property I may posses at my death including Land, stock, household and kitchen furniture, in fact all property of every description be given to my daughter in law, Mollie W. Johnston, wife of my son J. E. Johnston, for the use of herself her husband and children that are heirs of the said son J. E. Johnston, and at her death or marriage (should she be left a widow) it is to go to said children the heirs of J. E. Johnston, It is also my will that my son the said J. E. Johnston have the use of the lands that I may leave, to cultivate for the maintenance of his wife and children during his lifetime, but without the privilege of selling or otherwise disposing of the same. Item 2nd It is my express desire that my property be left, for the use and benefit of my son J. E. Johnston and his wife and his children, and it is my will that he the said J. E. Johnston shall not have the right or power to sell it in fee simple or for his lifetime, and that his wife Mollie W. Johnston, shall have the benefit of it her lifetime, or widowhood and should she Marry after his death, then My property is to go to his children the said J. E. Johnston’s bodily heirs. I appoint no executor for the simple reason that the property is to fo into the hands of those above designated without any process of law. In testimony whereof I have hereunto set my hand this 22nd day of November 1902 Catherine M. Johnston Signed and published by Catherine M. Johnston as her last will and testament in the presence of the undersigned who subscribe our names hereto as witnesses at the instance and request of said testator and in her presence and in the presence of each other This 22nd of November 1902 W. N. [?] Moore Sr. Lizzie Dunbar Josephus Coggin State of Georgia County of Pike Before me came W. N. Moore Sr. named as a witness toi the within writing purporting to be Mrs. Catherine M. Johnston’s last Will and being duly sworn saith that he with Lizzie Dunbar and Josephus Coggin J. P. at the request of Mrs. Catherine M. Johnston and in her presence and in the presence of each other did attest as witnesses the within writing as Mrs. Catherine M. Johnston will; that the same was signed and published by Mrs. Catherine M. Johnston in their presence as her last will; that she was at the time of said attestation and signing by her of sound and disposing Mind and Memory; that she executed the within paper voluntarily W.
