All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net September 23, 2006, 9:54 am Source: Pike County Probate Court Written: October 1, 1872 Recorded: November 12, 1873 In the name of God Amen I Gus Martin of Pike County State of Georgia being of sound mind and memory and considering the uncertainty of this life, do therefore make ordain publish and declare this to be my last Will and Testament; that is to say First after all my lawful debts and burial expenses are paid the residue of my Estate I give bequeath and dispose of as follows to wit: To my beloved wife Lizer Martin and my three beloved children to wit my daughter Martha Martin my daughter Jane Martin and my son William Martin each to have one fourth of my entire Estate each to receive of his one fourth of the cash and proceeds of crop or other property only so fast [?] and so much as he or she shall stand in actual need . The balance of each one fourth to be kept out at interest until thus appropriated. Except my wife Lizer is to keep one cow to be reckoned in her one fourth and that any stock necessary to carry on the family business may be kept together and not to be sold so long as it is to their best interest to keep them together, but in case it should become necessary to dispose of said stock or property then the cash proceeds to be managed and disposed of as the other cash and crop proceeds as mentioned above. In witness whereof I the said Gus Martin have to this my will set my hand and seal this the first day of October 1872 and I hereby appoint David N.[?] Martin my executor of this my last will and Testament Gus Martin his mark Signed sealed published and declared by the above named Gus Martin as his Last Will and Testament in presence of us and at his request who in presence of each other have subscribed our names as witnesses hereto E. F. Martin H. D. Cleveland [ _ ] McCord Georgia Pike County Before me came on the 25th day of Nov. 1872 at chambers for the purpose of proving the last Will and Testament of Gus Martin a person of Color the witness to said will viz H. D. Cleveland And the Will having been before that time brought before me for probate and the executor of said Will renouncing his executorship and the said witnesses depose of the same that they saw said Gus Martin sign and publish the same as his last Will on the day and year thus stated as executed by him that they witnessed the same at his request in his presence & in the presence of each other that the same was voluntarily executed by him while he was of sound mind and memory H.
