All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net September 23, 2006, 3:09 pm Source: Will Book D Pike County Probate Court Written: July 15, 1878 Recorded: September 2, 1878 In the name of God Amen I John Martin of the County of Pike and State of Georgia being of sound and disposing mind and memory, and being desirous to settle my worldly affairs while I have strength so to do make and publish this my last Will and Testament hereby revoking all wills by me at anytime heretofore made, and first I commit my soul to God who gave it, and my body I desire to be buried after my death in the usual manner of Christian burial and my worldly Estate I dispose of as follows Item First It is my wish and desire that if I should have any outstanding debts at the time of my death that a sufficiency of my property to be sold to pay off all my just debts Item Second I desire if my beloved wife Jane Martin should outlive me, that she shall have and enjoy my entire effects both Real & Personal during her natural lifetime. After her death to be sold and equally divided among my lawful heirs Provided nevertheless that there shall be no division of my effects as aforesaid until after the payment or maturity of the certain notes gave by me to H. A. Harp for the purchase money of lot of land No (37) thirty seven in Pike County Ga. for which said land I hold Bond for Titles Having disposed above of my Estate that I may be possessed of at the time of my death, I do hereby for the purpose of carrying into effect this my last Will and Testament, constitute and appoint my beloved son James J. Martin and James W. Hooks, my executors and I do hereby give to them the power after my death to settle up my business in accordance with the will without any formal administration In witness whereof we do hereunto set my hand and seal this July 15th 1878 John Martin Signed & Sealed in presence of us R. Lifsey JP Georgia Pike County Before me came on the 6th of August 1878 at chambers, for the purpose of proving the last Will and Testament of John Martin, one of the witnesses to such will viz; R. J. Mangham and the will having been brought before me for probate, by one of the executors James J. Martin who has filed a petition for probate of the same, he the said witness depose of the same, that he saw said John Martin sign and publish the same as his last Will on the day and year herein stated as executed by him, that they the said R. J. Mangham, J. N. Dearing B. A. Lifsey JP witnessed the same at his request, in his presence, and in the presence of each other, that the same was voluntarily executed by him, while he was of sound disposing mind and memory R. J. Mangham Sworn to and Subscribed before me this 6th day of August 1878 T. J. Blasingame Ordinary Georgia Pike County We James J. Martin and James W. Hooks do solemnly swear that the within writing contains the true last Will of the within named John Martin, deceased , so far as we know or believe, and that we will well and truly execute the same in accordance with the laws of this State So help us God James J.
