A. Murphy Georgia Pike County I A. A. Murphy Sr. of said County & State being of sound and disposing Mind and Memory do make this my Last Will and Testament Item First I bequeath & devise to my wife Caroline Houston Murphy & to my son A. A. Murphy Jr., and to any other child or children, the issue of myself and the said Caroline Murphy - whether born before or after my death, all my personal property, consisting of stock & vehicles notes and accounts deposited in banks & money and all other personal effects, that I may die seized and possessed of, said personal property is willed to be used for the support and maintenance of said wife and said child or children as may be appropriate and for their general benefit after they become adults Item Second I bequeath & devise to my wife Caroline Murphy for and during her natural life all the real estate I may die seized & possessed of, the rents and profits of the same to be used in supporting & maintaining herself and child or children the issue of herself & myself and also for providing said child or children in starting life work and maintaining them in such work Item Third I give and devise the remainder interest in said real estate to my son A. A. Murphy Jr. & to his full Brothers & Sisters if there be any at the death of their Mother, said remainder Interest & any increase thereof, to be inherited by the child or children or Grand child or children of the said Caroline Murphy & myself, but at the death of said Caroline Murphy there is no child or children & no Grand child or children of herself & myself living to take the remainder interest in said real estate & its natural increase, then & in that event said remainder interest is to go to my children by my first wife, viz: Belle & Emmie or to their children if either or both be not living at the time of said contingency. The purpose of this Item is to will that my children or Grand children by my second wife, viz, Caroline Murphy shall inherit my estate at death of said Caroline Murphy - but in the event there should be no children or Grand children by myself by her to inherit the same, then the estate is to be inherited by my children of Grand children by my first wife Brie V. [?] Murphy Item Fourth I direct my wife Caroline Murphy so long as she lives & my son Azmon and any brothers or sisters he may have, so long as they live, Keep up and care for the Old W. R. Murphy Burial ground situated in Monroe Co. GA. - deeds to which I have in trust for the Family. I also direct that a suitable grave stone something like or similar to the one that now rests over my Father’s & Mother’s graves, to be erected over my grave and placed by the side of my Mother’s. I direct that a sufficient amount be set aside annualy by my wife & son or children out of my estate to carry our the purposes of this Item Item Fifth I hereby appoint & constitute my wife Caroline Houston Murphy & my son A. A. Murphy Jr. the Executrix and Executor of this my last Will & Testament & relieve them of making and Bond or filing any report of their acts & doings with the Ordinary This Dec 31st 1907 A. A. Murphy as his last Will and Testament in the presence of us subscribers who subscribed our names hereto in the presence of said Testator at his instance & of each other he signing in our presence & we signing in his presence. Smith Georgia Pike County This is to say that I am in my right mind & fully understand what I am doing in writing this my additional to the within Will, I have advanced to my daughters Belle & Emmie, all their interest in my Estate & they have no interest in my estate except the contingency arises, as set ot in Item Third of the within Will, signed declared & published by A. A. Murphy Sr. as an addition to his last Will, written set out in the presence of us subscribers who subscribe our names hereto in the presence of said Testator at his instance and of each other he signing in our presence and we signing in his presence this Jany [sp] 10 1910 A. A. Murphy Mrs. Alice Hunt J. L. Hunt Jas. M. Smith Georgia Pike County Personally appeared before me the undersigned W. P. in and for said County Jas. M. Smith who being deposed & says that he the Jas. M. Smith who signed the attested Will & Testament of A. A. Murphy Sr. as a witness thereto Defendant further swears that the other subscribing witnesses whose names are signed thereto also saw said A. A. Murphy Sr. sign said Will. Deponent [sp] further says that about the date said Will bears Dec. 31st 1907 said A. A. Murphy Sr. being then of sound mind and memory signed declared and published said Will as his last Will and Testament in the presence of deponent & of J. Obed Whatley and J. T. Tyler & at the special instance & request of said A. A. Murphy Sr. Deponent & said J. T. Tyler and J. Obed Whatley then and there signed said Will as such witnesses in the presence of such witnesses and of A. A. Murphy & in presence of each other. Deponent further states that afterwards to wit - on or about January 10 1910 said A. A. Murphy Sr. in the presence of Mrs. Alice Hunt, J. L. Hunt and deponent as witnesses signed declared & published the addition to said Will, written thereon and dated Jany 10 1910 as an addition to his said Will and at the special instance and request of him said A. A. Murphy Sr. deponent & said Mrs. Alice Hunt and J. L. Hunt then and there signed their names as witnesses thereto in the presence of said A. A. Murphy Sr. & of each other he signing in their presence and they signing in his presence and in the presence of each other Jas M. Smith Sworn to and subscribed before me this August 10th 1910 J. A. McCrary Georgia Pike County Before me personally came J. T. Tyler, J. Obed Whatley & Jas. M. Smith named as witnesses to the attached writing purporting to be the last Will and Testament of A. A. Murphy Sr. who being duly sworn depose and say that they did on 31st December 1907 attest as witnesses the said attached writing in the presence of the said A. A. Murphy Sr. who in their presence voluntarily signed & published the same as his last Will and Testament, and that the said A. A. Murphy Sr. was at the time of said attestation and signing of sound and disposing mind and memory. Deponents say further that said A. A. Murphy Sr. signed Said Will & Testament in their presence and of the deponents and deponent attested the same in the presence of the said A. A. Murphy, and in the presence of each other J. T. Tyler J. Obed Whatley Jas. M. Smith Sworn to and subscribed before me Sept. 5 1910 J. W. Means Ordy Georgia Pike County Before me personally appeared Mrs. Alice Hunt, J. L. Hunt & Jas. M. Smith named as witnesses to the attached writing purporting to be the addition or codicil to the last Will of A. a. Murphy Sr. hereto attached who being duly sworn depose and say that they did on the 10th of Jany 1910 attest as witnesses this attached addition or codicil in the presence of the said A. A. Murphy Sr. and in the presence of each other the said A. A. Murphy Sr. in the presence of deponent voluntarily signed published the same as an addition or codicil to his last Will which had been previously made by the said A. A. Murphy Sr. The said A. A. Murphy at the time of said signing & attestation was of sound and disposing Mind & Memory Mrs. Alice Hunt J. L. Hunt Jas. M. Smith Sworn to and subscribed before me September the 5th 1910 Georgia Pike County I do solemnly swear that the attached writing contains the true last Will and codicil of the within named A. A.
