This file was contributed by: Doris Irons Greer caldor@neto.com ========================================================================= JAMES RIGGINS will; Pike County Georgia - 4th July 1842 Book B - pages 91 thru 95 -91- Georgia } I, James Riggins of this state and county in accordance to my own firm Pike County} will and wish being of sound mind and disposing memory devise and ordain this to be my last will and testament hereby revoking all other wills heretofore made by me. Moved by a filial love and regard for my affectionate wife and beloved children and having a Christian home my earthly estate shall after my demise be disposed of and herein will, grant and bequeath as follows (to wit) unto my beloved wife Polly Riggins for her own exclusive use and benefit. Four Negros (to wit) Maria an aged woman, Lydia a woman Simon a (?Town) man and Sam a man. The lot of land wherein I now live with all the improvements thereon, being lot No. (261) two hundred & sixty one, lot No. (252) two hundred & fifty two and fractional No. 279, two hundred & seventy nine, all in the ninth District of originally Monroe now Pike County one thousand dollars in Specie, two work horses & gear and all necessary farming utensils to correspond, one Black yolke of oxen & one wagon, five cows & calves, twenty head of stock hogs. Two beds, steads & furniture and all necessary household furniture she may want, the (---?Sillar) as well as the stock to be of her own choosing and after her death the land & Negros to revert to my beloved children equally. Subject Negro children to such conditions as will herein after follow (to wit) she , my beloved wife Polly will be expected to take in charge and support until they shall have arrived of age or marry free of expense to these my minor children. It is my will and desire that my beloved daughter Bethsheba Dominique have & I do hereby give unto a certain Negro girl -92- Hannah for her own exclusive use and benefit not subject to the use or control of her husband in any wise and after her death to go to her children born or to be born; it is may will and desire that my beloved daughter Mary Williamson have & I do hereby give & bequeath unto her for her own exclusive use & benefit, subject to no other control whatever, a certain Negro girl named Dill or Deliliah and after her death to go to her children (if any). It is my will and desire that my beloved daughter Sarah Riggins have & I do hereby give & bequeath unto her for her own exclusive use and benefit a certain Negro girl by the name of Rachael, one horse and saddle to be worth one hundred dollars, three cows & calves, one bed & bedstead & furniture. The above to be subject to the use & control of none else & after her death to revert to her children, if she has any. It is my will and desire that my son James Jefferson Riggins have & I do hereby give unto him a Negro boy by the name Charles, three cows & calves one bed, bedstead & furniture one Lot of land No. (224) two hundred & twenty four in the ninth district of originally Monroe now Pike County. It is my wish & desire that my son William Riggins have & I do hereby give unto him a certain Negro boy by the name of Elliot or Alexander, one horse & saddle to be worth one hundred dollars, three cows & calves one bed, bedstead & furtniture. Lot of land No. (261) two hundred & sixty one & fraction No. (279) two hundred & seventy nine in the ninth district of once Monroe now Pike County. This land not to be inherited until after the death of his mother & of course -93- proved for the disposition of that part of her estate after her death. I do hereby declare & make known that this foregoing bequests to Bethsheba Dominique, Mary Williamson, Sarah Riggins & sons James Jefferson & William Riggins and intended to make up to them a portion of my estate equal to that which I have already given to all my other children and are not to be counted against them in the general distribution of my Estate. It is also my will and desire & I do hereby desire that after the distribution of my estate. It is also my will and desire & I do hereby desire that after the distribution of my Estate herein before directed and after the payment of my just debts that all the remaining part of my estate whether real, personal or Negro be equally divided by sale among all my children to be given to my daughters particularly for their own exclusive use & benefit, not subject to the use & control of their husbands and after their deaths to go to their children, both born & to be born & that portion of my Extate herein given to my beloved wife Polly (the land excepted) after her death to be equally divided among all my children, to my daughters for their own exclusive use & benefit as aforesaid and at their death to go to their children then born & to be born. It is my will and desire and I do hereby declare that all my Estate before division to my beloved daughters (viz) Elizabeth Spear, Matilda Justice, Terisy Barker, Nancy Bagwell, Bethsheba Dominique, Mary Williamson & Sarah Riggins is to be enjoyed & held by them as a separate Estate for their own exclusive use & benefit subject in no wise to the control -94- of their husbands: And after their death to descend to their children: it is my wish and desire and I accordingly appoint my beloved son Joshua Riggins, (Minton or Milton )Riggins, James J. Riggins, Joseph Spear, Jas. Justice, Thos. Barker, Blakely Bagwell, David Dominick, Joseph Williamson my executors to carry into effect this my last will and testament. It is further my wish and I do hereby declare that if any of my children on ligature shall raise a disturbance without grand cause - then such one shall have one dollar for his portion & that past heretofore assigned such ligature shall be equally divided among the other ligatures under the precise system or plan afore name. Having in this my last will and testament undivided to equally provide for all my beloved children & wife, I now commend them to the superintending witness of a divine providence. Riggins, Thomas Barker, Blakely Bagwell, David Dominick & Joseph Williamson do solemnly swear that this writing contains the last true will & testament of James Riggins deceased so far as we know or believe & that we will well and truly execute this same by paying first the debts & then the bequest contained in this said will as far as his goods & chattels will thereunto extend & the law charges & that we will make a true and perfect inventory of all such goods & chattels sworn to & subscribed in open court. this 4th day of JUly 1842 Test.
