Margaret Jane Scott, William S. Scott, Joseph M. Scott, Robert M. Scott & Zachariah T. Scott, and it is my will and desire that they divide the whole of my estate aforesaid among them by lot or private sale as to my Executor hereinafter named shall seem most fit and proper. 2nd It is my will desire that neither my daughter Mary C. Jackson nor her husband Hardy R. Jackson nor my daughter Sarah A. Coggin wife of Mathew P. Coggin nor Mary E. Holsey wife of Robert Holsey nor neither of them receive any portion of my estate but that the whole of my estate as aforesaid go to and be equally divided among my children named in the first item of this will share and share alike for ever [ _ ]. 3rd I hereby appoint my son William S. Scott executor of this my last will and testament, In witness whereof I have hereunto set my hand and seal this 28th day of May 1861 Mary Scott her mark We whose names are hereto signed done so at the request of Mary Scott, she declaring the same to be her last will and testament, she signing the same in our presence and we each in the presence of each other. Mitchell Georgia Pike County Before me came on the 23rd February 1864 at Chambers for the purpose of proving [?] the last will and testament of Mary Scott the witnesses to said will J. H. Mitchell & Hartford Green and the will having been brought before me for probate by the Executor who has filed a petition for probate of the same they the said witnesses depose of the same that they saw said Mary Scott sign and publish the same as her last will on the day and year then stated as executor by him that they witnessed the same at his request in the presence and in presence of each other that the same was voluntarily executed by her while she was of sound and deposing mind & memory. Hartford Green John H. Mitchell Sworn and subscribed Feby the 23rd 1864 Z. Sims Ordy. Georgia Pike County I William S. Scott do solemnly swear that this writing contains the true last will and testament of the within named Mary Scott deceased so far as I know or believe, and that I will well and truly execute the same by paying first the just debts and then the Legacies contained in said will as far as her goods and chattels will whereunto extend and the Law charges me and that I will make a true and perfect inventory of all such goods and chattels so help me God.
