Item 1st I devise and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life Item 2nd I devise and direct that all my just debts and Testamentary expenses be paid by my executors herein after appointed out of my estate Item 3rd As all my property real and personal is now in litigation and as I have employed my attorneys and counselor at Law McClure [?] and Borders to conduct said litigation in [ _ ] the pretended [?] will of my late husband James Shipp. It is my will and desire that my executors hereafter named continue to prosecute in my [ _ ] said litigation and that my said attorneys be paid out of my estate real and personal for their services in that [ _ ] in manner and form as I have heretofore stipulated with them. Item 4th It is my will and desire and I do hereby give and bequeath and devise unto my beloved sisters Cassandra Murphy and Margaret Moon all my estate both real and personal in possession and expectancy after the payment of my just debts and expenses and after one third part of my said estate is dedicated for the payment of any said Attorneys to be held by my said sisters Cassandra Murphy and Margaret Moon and divided between them equally share and share alike Item 5th I hereby Constitute and appoint my beloved brothers in Law Robert Murphy and Jesse Moon executors of this my last will and Testament Rhoda Shipp her mark Signed sealed declared and published by Rhoda Shipp as her last will and Testament in the presence of us the Subscribers who have subscribed our names hereto at the request of Testatrix in her presence and in presence of each other this August the 20th 1853 Jas. State of Georgia Spalding County We Tilman Fuller and Edmund Seagraves do solemnly swear that we saw Rhoda Shipp by making her mark, Sign and Seal and heard her publish & declare this writing to be and contain her last will and testament that at the time thereof she was of Sound disposing mind and memory and that she did it freely without Compulsion to the best of our knowledge, that we subscribed the same at her request and in her presence and in the presence of each other and that we saw James T. Ellis do likewise Edmund Seagraves Tilman Fuller Sworn to and subscribed in open court this 5th day of Sept 1853 Wm. L.
