PIKE County Georgia - Wills Sherod Sims Sherod Sims will dated August 20, 1860 Bk C 250-254 Pike Co., Georgia Contributed by: Doris Irons Greer caldor@neto.com State of Georgia ) Pike County ) In the name of God - Amen I Sherod Sims of Said State And County being of advanced age but of Sound and disposing mind and memory Knowing that I must Shortly depart this life deem it - right - and proper both as respects by family and myself that I should make a disposition of the property with which a Kind Providence has blessed me. I do therefore make this my last will and Testament hereby revoking and annulling all others by me heretofore made. First. I desire and direct that my body be buried in a decent and Christian like manner Suitable to my circumstances and condition in life. My Soul I trust Shall return to rest with God who gave it - as I hope for Salvation through the merits and atonement of the blessed lord and Saviour Jesus Christ. Secondly I desire and direct that all my just debts be paid without delay by my Executor hereinafter named and appointed. Thirdly To my beloved daughter Sarah Cauthen wife of James Cauthen Dec'd. I give bequeath and devise a Negro woman named Temsy about thirty five years old and a boy named Andrew about ten years old. Fourthly To my beloved Daughter Mary Cauthen wife of Thomas M. Cauthen I give bequeath and devise for her sole and separate use for and during her natural life free and exempt from the debts and liabilities of her present or future husband the following property to wit My Negro woman Ann about thirty years of age and her child Ben about five years old and her child Joe about three years old she paying back to my Executor two Hundred and fifty Dollars or to leave the boy Joe with the Executor. The property in this article contained (at the death of my Daughter Mary Cauthen) shall pass to and become the property of the children and representatives of Children of said Mary Forever. Fifthly To my beloved Daughter Elizabeth Sims wife of Artemus Sims for her use and for her children I give bequeath and devise the sum of One thousand Dollars to be paid upon a final distribution of My Estate. Sixthly To my beloved son Sherod S. Sims I give bequeath and devise the following property to wit One lot of Land Number Thirty four and Fifteen acres off of Lot Number Thirty One as follows. Vis Commencing at the North East Corner of Lot No Thirty One at the gin house running thence due West for enough to embrace all the improvements and orchard, thence due East to the South line of lot Number Thirty thence due South to the place of beginning with all the rights members and appurtenances to said Land in any wise belonging forever in fee Simple. The above described Land lying & being in the third District of Originally Monroe now Pike County, Ga. also my Negro boy Sam about eighteen years old. My Negro woman Rachel about twenty years old and her child Abram five months old. Should My beloved Son Sherod S. Sims die without any child or children the property described in this article named is to revert back to my Estate & to be equally divided among the legal representatives of my estate then living. Seventhly To my beloved son Jasper Sims I give bequeath and devise Lot of land Number two and ten acres off of Lot Number one as follows Vis commencing at the North west corner of Lot number one running thence due East for enough so as to Include all the Improvements & Spring thence due South far enough to include all improvements and the Spring and thence due west to the western line of Lot number one & thence due North to the place of beginning the described Land lying and being in the third district of Originally Monroe now Pike County with all the rights members and appurtenances to all of said land in any wise belonging forever in fee Simple. Also my Negro boy John about Fourteen years old and my boy Charles about Twelve years old. The property described and named in this article to remain in the hands or under control of my Son Sherod S. Sims as trustee for my Son Jasper and Should my Son Jasper Sims die without leaving any child or children the above described property is to revert back to My estate to be Sold and equally divided amongst the legal representatives of My estate who may be then living. Eighthly To my beloved son Newton Sims I give bequeath and devise the following property to wit Lot of Land number Thirty One except fifteen acres off of the North East Corner of Said lot as described in the Sixth article also my Negro man Reuben about twenty five years of age. Ninthly To my beloved Grand Daughter Elizabeth Duncan Formerly Elizabeth Head daughter of William W. Head I give bequeath and Devise the Sum of five Dollars. Tenthly To my beloved Grand Daughter Mary Head Daughter of William W. Head I give bequeath and devise the sum of five hundred Dollars upon her arrival at the age of twenty one years and I hereby appoint my beloved Son Sherod S. Sims Guardian of my said Grand Daughter Mary Head. Eleventhly To my beloved Grand Son Sherod G. Head son of William W. Head I give bequeath and Devise the sum of Five hundred Dollars upon his arrival at the age of Twenty one Years and I hereby appoint by Beloved Son Sherod S. Sims Guardian of my grand Son Sherod G. Head. Twelvethly To my Grand Daughter Elizabeth Clark wife of John Clark deceased I give bequeath and devise one half of Lot of Land Number Thirty Five with all rights members and appurtenances to said Half Lot of Land in any wise belonging forever in fee simple. She to take choice of Said half lot of Land. Thirteenthly To my grandaughter Louisa Reid wife of Allen Reid I give bequeath and devise Three hundfred dollars to be paid upon a final distribution of my estate. Fourteenthly To my beloved son Sherod S. Sims I give bequeath and devise all my stock of Hogs three cows and Calves One horse and buggy and once choice mule five beds bed stead and furniture. Fifteenthly I give to my beloved daughter Sarah Cauthen wife of James Cauthen deceased after my decease my Negro boy George about five years old. Sixteenthly The residue of my property both real and personal where ever and whatever it may be not enumerated in the forgoing Items I devise to be Sold and the proceeds of the same to be equally divided between the above named legatees. Seventeenth I hereby constitute and appoint my beloved son Sherod S. Sims Executor of this my last will and testament this August 20th 1860. Hood and the will having been before that time brought before me for probate by the Executor Sherod S. Sims who has filed a petition for Probate of the same. They the Said witnesses depose of the same that they Saw Said Sherod Sims Sign and Heard him publish the same as his last Will on the day and Year then Stated as executed by him that they witnesses the same at his request in the presence and in presence of each other that the same was voluntarily executed by him while he was of Sound and Disposing mind and memory.
