Mangham of said county and State being sound in body and of sound and disposing mind and memory do make and declare this to be my last Will and Testament. Item 1st - I give and bequeath to my dear and very much beloved daughter, Lucilla (?) Ann, for and during her natural life time free and exempt from any and all debts, liabilities, contracts,, and control of any husband she may have (not even a lifetime estate) and at her death to her children or child and if she should die without living issue to go back to my little daughter on the same conditions as was given to her and if both should die to revert to and become common property of my estate and to be equally divided between my legal heirs, the following property to wit, Moses a man and Cynthia a woman (?), a boy Squire, a boy Jefferson, a boy Jememiah, a boy Samford, a boy Moses, a boy Nicy, a girl Fannie, a girl Aggy, a small child also Aggy and of a woman who I wish kept together and well treated. Item 2nd I give and bequeath to my dear and very much beloved little daughter Rebecca Elizabeth for and during her natural lifetime free and exempt from any debts, liabilities, contracts, or control (not even a lifetime estate) of any husband she may have and at her death to her child or children, and if she should die without issue to go to my other daughter on the same conditions as was given to her, and if both should be dead to revert to and become common property of my estate and be equally divided between my legal heirs at law the following property to wit - Richmond a man, Hester a woman, Harriet a girl, Elijah a boy, and Mary a girl. Inly a woman, William Thomas (Commonly called Boss). Oula a girl, Emma a girl, and John Robert a mulatto boy and their future increase, also as a nurse Sukey a woman, and Lu Linda who I wish to be kept together and well treated by my said daughter. Item 3rd It is my will, wish, and desire that my executors here in after ? Sell at private or public sale as they may think most conductive to the interest of my estate, the remainder of my Negroes and all of my land in this county and other counties, stock of every description, collect all debts, and after a fair and correct valuation of the Negroes given to my daughters, then the one having the smallest amount of Negroes to be made equal in money and after that pay all debts and expenses, then the balance to be equally divided between my two daughters and to be received by them or their husbands upon the same conditions the Negroes were given. Item 4th I hereby constitute and appoint my much esteemed brother Wiley E. Mangham so long as he shall live to act as my executor to this my last will and testament and further appoint said Wiley E. Mangham and John W. Mangham to act as trustees for my two daughters in this will named. Item 5th It is my wish and desire that my executors have the remains of my dear little daughter who died in 1839 and was buried out at the graveyard at my fathers, disinterred and brought and reintered at the Methodist Church Yard in Zebulon by the side of her mother and a nice box plus stone of marble with appropriate inscription put over each of their graves - my dear and much beloved wife. Mangham as his last will and testament in the presence of us describers who subscribe our names hereto in the presence of said Testator at his special ? Mangham being produced in open court to be proven and the ? of said will came in open court at this regular term of court Charles F. Redding and J.J. Caldwell and being duly sworn deposes and says that they saw John ? Mangham sign and publish the within as his last will and testament while of sound and disposing mind: that they ? The same for him at his request and in his presence and in the presence of each other and that the same was executed voluntarily by him on the day it preposes to have been executed, sworn to and subscribed before me in open court. Mangham deceased, so far as I know or believe, and that I will well and truly execute the same by saying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charges me, and that I will make a true and perfect inventory of all such goods and chattel so help me God.
