I, Zacharaih Lewis Fryer Sr. of said State and County, being of advanced age and knowing that I must shortly depart this life, deem it right and proper both as respects myself and my family that I should make a disposition of the property with which a kind Providence has blessed me, do therefore make this my Last Will and Testament. 1st Item I desire and direct that my body be buried in a decent and Christian like manner, suitable to my circumstances and condition in life. My soul I trust shall return to rest with God who gave it as I hope for eternal salvation through the merits and atonement of the blessed Lord and Savior Jesus Christ whose religion I have professed and as I humbly trust, enjoyed for many years. 2nd Item I desire and direct that all my just debts be paid without delay by my Executors herein after appointed, as I am unwilling my creditors should be delayed in their rights, especially as there is no necessity for such delay. 3rd Item I give and bequeath to my son, Hardy Crawford Fryer for and during his natural life and to his children at his death for his and their use and benefit during his life and for the use and benefit of his children at his death, the following property - to wit - Robert, a Negro man about twenty seven years old. Hennrietta a girl about seven years old and Henry, a Negro boy about five years old. 4th Item I give and bequeath to my daughter Susan Christian, wife of John G. Christian, for and during her natural life, and to her children at her death, and free from the disposition of her present or any future husbands, besides Rachael a Negro woman heretofor given her, the following Negroes - to wit - Rose a Negro girl ten years old and Will, a Negro boy about five years old. 5th Item Besides two Negroes by name Lucretia and Lyddia previously given her, I give and bequeath to my daughter Charlotte Willis, wife of George Willis for and during her natural life, and to her children at her death, free from the disposition of her husband or any future husband, my Negro man Ferry about fifty years old. 6th Item I give and bequeath to my daughter Emily Herbert Kindrick, wife of Samuel S. Kindrick, for and during her natural life and to her children at her death, free from the disposition of her present or any future husbands, besides two Negroes, by name Beckley and her child Julia, the following Negroes - to wit - Simon, a boy about seven years old. 7th Item I give and bequeath to my daughter Sarah Brown, wife of Charles W. Brown, for and during her natural life and to her children at her death, free from the disposition of her present or any future husbands, besides a Negro woman named Nicy heretofor given her, the following Negroes - to wit - Spencer a man about twenty seven years old and Tiny a Negro woman about thirty seven years old. 8th Item I give and bequeath to my daughter Permelia Amanda Christian, my Negro man Monday, about twenty six years old, Mourning, a Negro woman about twenty five years old and Anna a Negro girl about four years old to her forever. 9th Item I give, bequeath and devise to my daughter Permelia Amanda Christian, as much of the northern front of lot of land number seventy eight in the seventh district of the State and County aforesaid as shall include my dwelling house and all other buildings thereon by a straight line parallel with the northern boundary line and connecting the eastern and western boundary lines, thereof all the lands enclosed within said boundaries being something more than one half of said lot, also the adjacent south half of lot of lands number seventy seven in said District, a part of which lands are cleared and in cultivation , with all the rights, members and (?) to said land in anywise belonging free from all charge or limitation whatever - to her own proper use, benefit and behoof forever, with full power to dispose of the same at any time previous or by will, or deed at her death as she may think proper. 10th Item I give and bequeath to my son John Augustus Fryer for his separate benefit during his natural life and free and exempt from any debts and liabilities he has heretofore contracted the following - to wit - Nancy a Negro woman about forty years old, her child Amy, and infant about six months old, Harry a Negro man, husband of Mourning, about forty years old, and Peter, a boy about fifteen years old, and I hereby appoint my daughter Permelia Amanda Christian, trustee of the property herein given and bequeathed to my son John Augustus Fryer, and I further appoint and direct that my son John Augustus Fryer whenever he so prefers may become his own trustee and hold in his own name the property conveyed in this item. 11th Item I give and bequeath to my son Benjamin Mathews Fryer, for and during his natural life, and at his decease for his children, for his and their benefit during their joint lives and at his death for the benefit of his children the following property - to wit - George, a Negro man about thirty years old previously given him, Green, a Negro man about twenty two years old and Columbus a boy about twelve years old. 12th Item I give and bequeath to my son Zachariah Lewis Fryer the following property - to wit - a Negro man Edmond about twenty four years old and a Negro boy Sack about five years old, to him forever. 13th Item I give and bequeath to my daughter Marry Perry, wife of William (?) Perry, for and during her natural life and to her children at her death, free from the disposition of her present or any future husband besides, a Negro woman named Ann, previously given her, the following Negroes - to wit - Jacob, a boy about thirteen years old and Celia a woman about fifty years old. 14th Item I give and bequeath to my son James Hamilton Fryer, certain notes and one execution against him, Said notes and execution having been paid by myself - to wit - one note of twelve hundred seventy-six and 50/100 dollars made payable to Wm. B. Murphy, dated Dec. 26, 1855. One note of thirteen hundred sixty-six and 17/100 dollars made payable to James Whatley and dated February 6th 1854. One note of ten hundred and forty five and 85/100 dollars payable to James Whatley and dates May 30th 1853. One note of 500 dollars payable to James Whatley and dated July 22, 1854 and one execution in favor of James Neal of one thousand one hundred eighteen and 94/100 dollars with interest and costs, and dated July 5, 1855 together with the interest on said notes and execution. 15th Item I give and bequeath to my daughter Caroline Julia Goodwin, wife of Coleman Green Goodwin the sum of fifty dollars. 16th Item The residue of my property both real and personal wherein and whatever it may be, I design and direct my Executors to sell in due course of law, and after paying one tenth of the monies accruing from such sale to my daughter Permelia Amanda Christian for her use and benefit and behoof forever, to so divide the remaining nine tenths of said monies between my daughters Emily Norbert Kendrick, Susan Christian, Sarah Brown, Charlotte Willis, Mary Perry, and my sons John A. Fryer, Benjamin M. Fryer, Zacharaih L. Fryer, and Hardy Crawford Fryer as to make their respective legacies near equal as practicable 17th Item I hereby constitute and appoint my son in law Charles W. Brown and my son Hardy C. Fryer Executors of this my Last Will and Testament. Zach L. Fryer Signed, sealed and declared and published by Zachariah Lewis Fryer as his last Will and Testament in the presence of us subscribers who subscribe our names hereto in the presence of said Testator (at his special instance and request) and of each other.
