Item 1st: I desire and direct that my body be buried in a decent Christian like manner suitable to my circumstances and condition in life. Item 2nd: I desire and direct that all my just debts be paid without delay by my executors herein after appointed. Item 3rd: I will give and bequeath to my beloved son Phillip Ballard a Negro boy about fifteen years of age by the named of George Washington commonly known by the name of George - I also will, give and bequeath to my beloved son Phillip Ballard another Negro by the name of John Henry - about twelve years of age commonly called by the name of Henry. Item 4th: I give, will and bequeath to my beloved son James Ballard, Francis, a Negro girl about fourteen years of age and I also give and bequeath and will to my beloved son James Ballard another Negro boy by the name of Ham (?) about ten years of age. Item 5th: I will, give and bequeath to my beloved daughter Edna May(?) Osborn the wife of Green B. Osborn a Negro boy by the name of Parris about eight years old. Item 6th: I will and bequeath and direct that Fanny, a Negro woman about fifty years of age and Cyrus(?) a Negro boy eight years of age be sold at the highest bidder at public out cry by my executor herein after named and the proceeds thereof equally divided by my executors between the following of my named children and grand son John Thomas Ballard, son of my deceased son John Ballard, Jane Trammel(?) my daughter, wife of __?__ B. Trammel, Sarah Davis, my daughter, wife of Simon Davis, Gideon Ballard, my son, Elizabeth Brumbelow, wife of Ezikiel(?) Brumbelow, Samantha Robertson, wife of Green B. Robertson, Mary Upchurch, wife of Lumsford Upchurch and John Thomas Ballard son of my deceased son John Ballard and my grand son. Item 7th: I will that the part coming to my daughter Elizabeth Brumbelow be given in trust that the same be free from and exempt from the present or future liabilities of her said husband. Item 8th: I hereby constitute and appoint my sons Phillip Ballard and James Ballard my executors of this my last Will and Testament. August 1st 1837. Mary Ballard Signed sealed declared and published by Mary Ballard as her last Will and Testament in the presence of us the Subscribers who subscribe our names hereto in the presence of said Teastor at her special instance and request and of each other. James do solemnly swear that we saw Mary Ballard sign seal and declare and publish and declare this writing to be and contain her will at the time thereof she was of sound disposing mind and memory and that she did it freely without compulsion to the best of our knowledge and belief and that we saw Thomas D. King Esq. sign the same as witness called in open court this 3rd day of November 1837. James Hancock George B. James Wiley E. Mangham State of Georgia Pike County We Phillip Ballard and James Ballard do solemnly swear that this writing contains the true last Will and Testament of Mary Ballard late of said County deceased as far as we know or believe and that we will well and truely execute the same by paying first the debts and then the legacies contained in said will as far as her goods and chattels will __?__ and that we will make a true and perfect inventory of all such goods and chattels so help us God.
