All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net October 26, 2003, 9:07 am Source: Pike County Probate Court Will Book C - page 99 Written: November 15, 1851 Recorded: December 1, 1851 Georgia Pike County November 15, 1851 In the name of God Amen, I James Shipp being affected in body but sound in mind have thought proper to dispose of my worldly affairs in the following manner - to wit- 1st My just debts shall all be paid 2nd There shall be three hundred dollars of money given out of my estate by my administrators unto the Church at Flat Rock to the Trustees so long as the church remains an established church 3rd My Negro man Isaac to be sold unto the highest bidder and the money given unto my brothers William Shipp' son James Shipp 4th My land and farming implements and my Negroes Mariah, Hannah, Manda, Gabriel, Lee and a boy Hampton, Silas a boy shall be kept together on my farm and belong unto my wife during her lifetime of widowhood. 5th And to my adopted son Richard Prior shall remain with my wife Rody and be supported out of the proceeds of my estate until he arrives at the age of twenty one and if my wife Rody hereto marry sooner the then said R. Prior shall be and I hereby make him my heir of my whole estate but not until the death or intermarriage with some other man and should Richard Prior depart this life before my wife Rhoda Shipp, without lawful heir then and in that event after the death of him and my wife there without heir, my whole estate shall revert back unto my two brothers William M. Shipp and Lemuel G. Shipp or their heirs with an equal division. 6th I hereby ordain and appoint Josiah Pyror of the County of Pike and Lewis Pryor of Meriwether my executors of this my last will and testament. Woods do solemnly swear that we saw James Shipp (by making his mark) sign and seal, publish and declare this writing to be and contain his will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and belief and that we also saw John Foxworth sign the same as witness. Mangham, CCO State of Georgia Pike County We Josiah Pryor and Lewis Pryor do solemnly swear that this writing contains the true last will and testament of James Shipp late of said county deceased so far as we know or believe and that we will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as said goods and chattels will _?_ _?_ _?_ the law charges us and that we will make a true and perfect Inventory of all such goods and chattels so help us God.
