All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: William Russell dragonraj@comcast.net October 26, 2003, 10:25 am Source: Pike County Probate Court Will Book C Written: January 3 1850 Recorded: May 14 1852 State of Georgia Pike County I, Laban Short, of the state and county aforesaid being of advanced age and knowing that I must shortly depart this life, deem it right and proper both as respects myself and family, that I should make a disposition of the property with which a kind providence has blessed me, do therefore make this my last will and testament. 1st Item I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life. 2nd Item I desire and direct that all my just debts be paid by my executrix hereinafter appointed. 3rd Item I give, bequeath and devise to my beloved wife Rebecca one hundred acres more or less of lot of land number one hundred and ninety eight, it being the east half of said lots, it being the place on which I now reside in the second district of originally Monroe, now Pike County with all the rights, numbers, and _?_ and to said _?_ lot off the land in anywise belonging to her own proper use, benefit, and behoof for and during her natural life, together with my Negro Milly, a woman about forty five years old, Abram, a boy about sixteen years of age, Eliza, a girl about ten years old, Lucy a girl two years old, with all my household and kitchen furniture belonging to and used on said plantation, with all my horses, hogs, and cattle with all other property belonging to the aforesaid _?_ all of which she is to hold for and during her natural life "only" 4th Item I desire and direct that all the afore described property with its _?_ increase thereof, after the death of my beloved wife Rebecca be divided as follows: to my son Howell, one tenth of the whole of the above described estate and one tenth of the increase thereof. To the heirs of Elizabeth Ann Thompson, my daughter deceased, one tenth. To my son William T. Short, one tenth. To my daughter Nancy N. Starky(?) one tenth. To the heirs of my son John C. Short deceased, one tenth. To my son Anderson F. Short one tenth. To my daughter M (?) Bankston, one tenth. To my son Nathan P. Short one tenth. To the heirs of my daughter Melissa Pounds deceased, one tenth. To my daughter Rebecca Bankston, one tenth. 5th Item I hereby constitute and appoint my beloved wife Rebecca Short Executrix and my son Howell and my son in law Willoughby S. Bankston executors of this my last will and testament, this the 3rd of January 1850. Laban Short (his mark) Signed sealed declared and published by Laban Short as his last will and testament in the presence of the subscribers who subscribed our names hereto in the presence of said testator at his special instance and request and of each other this January 3rd 1850. _?_ H. Head, and _?_ Smith do solemnly swear that we saw Laban Short (By making his mark) sign and seal and heard him publish and declare this writing to be and contain his will and at the time thereof we are of the opinion that the Teastor as in possession of mind and memory to the extent of individuals cited by the Supreme Court in the Potts case, and if that be the law as to the _?_ of mind and memory, we consider him possessed both to that extent and that he did it freely and without compulsion to the best of our knowledge and that we also saw Benjamin Seagraves sign the same as witness. _?_ H. Bankston do solemnly swear that this writing contains the true last will and testament of Laban Short late of said county deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will _?_ _?_ extend and the law charges and that I will make a true and perfect inventory of all said goods and chattels so help me God.
