Varner being in feeble health and knowing that it is ordained for me to die, and being of sound and disposing mind and memory do make publish and declare this to be my last will and testament. Item 1st I give and bequeath unto my uncle John Neal my Negro man _?_ also I give and bequeath unto my said uncle John Neal six hundred dollars and my buggy also. Item 2nd I give and bequeath unto my brother John F. Varner my Negro boy Frank and my Negro man Jerry, also three lots of land in the Cherokee part of the State of Georgia, one containing forty acres drawn by Alva Wilson, one containing one hundred and sixty acres number (227) in the 9th district of Gilmer County, the other drawn by Robert Scott, number (1) in the (10) tenth district of Gilmer County, also my interest in a Lot of land in Macon County , Georgia formerly Houston County - also I give unto the said John F. Varner my two horse wagon. Item 3rd I give and bequeath unto my niece Elizabeth Thomas _?_ eight hundred dollars, also one half of my household furniture she selecting which half she pleases. Item 4th I give and bequeath unto Minerva J. Waller fifty acres of the land around the house and including the improvements of lot of land number two hundred and fourteen as well as _?_ _?_ it being the place whereon she now resides, the balance of said lot I give and bequeath unto the said Minerva J. Waller and her four children William Waller, John Waller, Martha Waller, and the infant daughter which I suppose will be called _?_ _?_, and it is hereby expressly understood and directed that if my executors herein after named should think it most to the interest of said Minerva J. Waller and her named children, to sell the balance of said lot of one hundred and fifty two and a half acres of land that they should do so and apply the proceeds for the benefit of the said Minerva J. and her four said children as in their discretion they think best. Item 5th I give and bequeath unto William Waller, son of Minerva J. Waller, and my natural son, one thousand dollars. Item 5 I give and bequeath unto John Waller, son of Minerva J. Waller also my natural son one thousand dollars. Item 6 I give and bequeath unto Martha Waller, daughter of Minerva J. Waller, my natural daughter, one thousand dollars. Item 7 I give and bequeath unto the infant daughter of Minerva J. Waller, she being the fourth and last child and also my natural child one thousand dollars. Item 8th I also give and bequeath unto the aforesaid four children of the said Minerva J. Waller, in common one Negro girl by the name of Ann about sixteen or seventeen years of age. Item 9th I give and bequeath unto William Varner and Eliza Varner, son and daughter of John F. Varner and nephew and niece of mine, four hundred dollars each, the interest of which said fund is to be applied for the benefit of said William Varner and Elizabeth Varner by their father John F. Varner in schooling and other personal benefits, the principal to be kept secure until they arrive of age or marry. Item 10th The balance of any household furniture after Elizabeth Thomas selects _?_ I give and bequeath unto Minerva J. Waller and her children also such of any _?_ _?_ as she may select. Item 11th In addition to the donation in the first item of this will, I give and bequeath unto my uncle John Neal fifty dollars more. Item 12th In addition to what I have already given Minerva J. Waller in this will I give and bequeath unto her, the said Minerva J. Waller three hundred dollars with advise to her to keep the principle at legal interest accrued and use the interest for personal purposes. Item 13th It is hereby further my will and desire that if my estate overruns the legacies _?_ thus and in that event - it is my will and desire that the balance shall be equally divided between Elizabeth Thomas, William Varner and Eliza Varner children of John F. Varner and William Waller, John Waller, Martha Waller and the infant daughter and youngest child of Minerva J. Waller and my natural children. Item 14th It is my will and desire that the four children of Minerva J. Waller shall receive a good common English education out of the interest of the money herein given to them. Item 15th I hereby nominate appoint my uncle John Neal and John _?_ Mangham and Wiley E. Mangham my executors to this my last will and testament with a request that they will all act if possible. Varner sign and seal and heard him publish and declare this writing to be and contain his will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of our knowledge and that we saw John G. State of Georgia Pike County We John _?_ Mangham and Wiley E. Mangham do solemnly swear that this writing contains the true last will and testament of David N. Varner late of this county deceased so far as we know or believe and that we will make a truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels shall thereto extend and the law charges us, and that we will make a true and perfect inventory of all such goods and chattels so help us God.
