Caldwell of the State and County aforesaid, advanced in years and of feeble bodily health, but of a sound and disposing mind and memory, do make declare and publish this my last will and testament hereby revoking all others heretofore made by me. Item 1st I will and desire that after my just debts if any and my funeral expenses are paid I will and bequeath to my beloved son James T. G. Caldwell for and during his natural life and after his death to his children if he has any child or children living, all of my plantation in the county of Pike whereon he now resides, containing four hundred and twenty acres more or less, in the event my son James T.G. Caldwell should depart this life leaving no child or children the said land to revert to and belong to my estate and be divided as directed in the secondary clause of this my will. The said James T.G. to take the plantation upon and as above named with the following conditions and requirements, he is to pay to my executors one thousand dollars in money which is to enable my executors to pay off the other legacies hereafter named and he is to permit my old servant Nelly who is too old to be of any service, to remain with him and take care of her, she to belong to him my said son James T.G. I also give to my said son my young colt and two sows and pigs, all the above bequests to my son and in consideration of the natural love and affection I have for them and in full _?_ of all amounts I may owe him as his Guardian. Item 2 I will and bequeath to my beloved son Oliver _?_ Caldwell for and during his natural life and after his death to go to and be the absolute property of his children, my Negro man Anthony and five hundred dollars, the above to be in extinguishment of all debts or demands my said son may have or hold against my estate. Item 3 I give and bequeath to my beloved son John J. Caldwell in trust and in trust only for my beloved daughter Martha Sarah Foster during her life and after her death to her children absolutely, seven hundred and fifty dollars, and desire and direct that my said son John shall purchase a Negro girl worth said money and take the _?_ to himself as the trustee of my daughter Martha and she the said Martha to have the use of said Negro girl and her increase during her life and upon her death the said Negro girl and increase to go to and belong to the children of my said daughter Martha S. Foster, wife of Edward G. Foster. Item 4 I give and bequeath to my beloved grand daughters Sarah E. and Mary R. Long, daughters of Gus L. Long to be _?_ my _?_ _?_ until they arrive of age or marry, the sum of five hundred and fifty dollars each and should either of my said Grand daughters die before marrying or coming of age I will that the other should have the whole of the deceased sisters share and should they both depart this life before marrying or coming of age the amount of the above bequest to be divided among my other legates. Item 5 I will and bequeath to my beloved son John J. Caldwell my black mule called Rock. Item 6 I will and bequeath to my beloved daughter Rebecca E. Mangham wife of John _?_ Mangham during her life and after her death to her children absolutely my two Negroes Hampton and Mariah upon the said Rebecca E. Mangham and John Mangham paying to my executor the sum of four hundred and forty seven dollars to enable him to pay the other legacies herein bequeathed, the acceptance of the above legacy to be a final relinquishment of all demands the said Rebecca E. and John H., have or hold against my estate. Item 7 I will and bequeath that my executor sell the whole of the _?_ at my estate and after paying the legacies mentioned on this my will the residue of the amount of said sales be equally divided among my children and my two grand daughters in the fourth item to receive of said _?_ as much as one of my children or a childs part between the two. Item 8 I appoint my beloved son John J. Caldwell executor to this my will and request that he take upon himself the duties of executor as aforesaid and have this my will justly executed which I confidently hope and believe he will. In _?_ where of I the said Eliza M. Caldwell have herewith set my hand and seal and declare this to be my last will and testament in the presence of the undersigned witnesses who by my request will sign the same as witnesses this 11th day of May 1835. Caldwell sign seal and declare the same to be her last will and testament and that she signed the same in our presence and that each of us signed as witnesses in her presence and in presence of each other this 11th May 1834 John Neal William M. Joiner(?) Hartford Green State of Georgia County of Pike We Hartford Green John Neal and William M. Joiner(?) the three subscribing principals(?) to the within will do solemnly swear that we saw Eliza M. Caldwell sifn seal and heard her publish and declare this writing to be and contain her will and at the time thereof she was of sound disposing mind and memory that she did of it freely without compulsion to the best of our knowledge and belief. Caldwell do solemnly swear that this writing contains the true last will and testament of Eliza M. Caldwell deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will so far as her goods and chattels will thereto extend and the law charges me and that I will make a true and perfect inventory of all such goods and chattels so help me God.
