Brown of the State and County aforesaid, made the twenty second day of November in the year of our Lord one thousand eight hundred and thirty three. In the name of God Amen. I John R. Brown being low in body but sound in mind and memory and calling to mind the mortality of this body do make and ordain this my last will and testament in the following manner. Item 1st I give unto my beloved son Stephen J. Brown two lots of land No. eight and nine adjoining in the Seventh District of originally Monroe, now Pike County, with all and singular the rights and _?_ thereof. And also one Negro man by the name of Robbin, a woman by the name of Siller(?) and her child Percy and a girl by the name of Margaret and another by the name of Grace and one boy by the name of Jack and another by the name of Esam(?) and also my household and kitchen furniture which is not hereafter mentioned and also two beds and furniture with all my plantation tools and also four cows and calves and half my stock of goats and sheep and one years support - out of my stock of hogs and one work mule and whereas my son Stephen J. Brown is bound with myself to pay certain promissory notes made payable to Joseph Hamilton ands all other debts which he has heretofore contracted for me or jointly, I will that all and singular such debts be paid out of my effects. Item 2nd I give unto my Grandson Horton Linsey Brown, son of my son Stephen J. Brown, one Negro girl by the name of Harriet, but if he should die during his minority she with her increase if any, shall fall to the first living heir of my son Stephen thereafter but if none during his natural lifetime, I will that she with her increase if any, be sold and the proceeds thereof divided amongst all my children. Item 3rd I give unto my beloved wife Ann Brown one bead stead and furniture, one grey (sp) horse, saddle and bridle, also I lend unto my (wife) one Negro girl by the name of Lucy during her natural lifetime and at her death the said girl with her increase if any, to be sold and the money equally divided among all my children, Stephen and Mark excepted. Item 4th I give unto my beloved son Luke Brown one hundred and twenty three and a half acres of land more or less it being a part of lot forty one in the seventh district originally Monroe now Pike County. Item 5th I give unto my beloved son Matthew Brown one bed and furniture. Item 6th I give unto the orphans of my son Henry Brown fifteen dollars each. Item 7th I give unto my two grandchildren Thomas and Elizabeth Brown son and daughter of my son Mark Brown fifty dollars each. Item 8th I give unto my beloved son Mark Brown twenty dollars in cash and a certain promissory note _?_ which I hold against him for fifteen dollars. Item 9th I wish that a certain tract of land which I drew in Lee County together with any other lot or lots which I may have drawn in any former lottery (if any( be sold whenever my executors think best and the proceeds hereof equally divided amongst all my children and whereas William H. _?_ and myself have entered into a certain verbal contract respecting our draws in the last lottery which contract I acknowledge by me before witnesses, I wish that my executors abide faithfully thereto according to the terms thereof. Item 1oth I will that the part of my plantation contained on the lots of land N. twenty four and twenty five in the Second district originally Monroe now Pike County be rented out the first year after my decease and fifty dollars of the money arising there from given to my wife Ann Brown and be sold whenever my executors may think best and most advantageous to my heirs at private or public sale as they may think best. Item 11th I will that my son Stephen have the benefit of making one crop upon my plantation after my decease with the use of my property before it is distributed according to this my will. Item 12th I will that all my property not heretofore mentioned be sold to the highest bidder at twelve month credit, my Negro man Sam(?) and his wife to be sold together and the purchaser to have two annual payments for them as also my Negro woman Sarah and her child or children in like manner and the proceeds thereof equally divided amongst all my children, Stephen and Mark excepted. Item 13th I constitute my two trusty friends Willie J. Milner and Samuel R. Nutt my executors to this my last will and testament ratifying and confirming the same and disannulling all other wills hereto fore made by me in any manner whatever. In witness whereof I have hereunto set my hand and seal this 22nd day of November 1833. John (his mark) R. Brown The word Matthew Brown in the 5th item and five in the 10th item interlined(?) before assigned, signed sealed and acknowledged in the presence of us. Henry Smith Wm R. Jones J.B. Jones You swear that you saw John R. Brown sign seal publish and declare this writing to be and contain his last will and testament. That at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of your knowledge, so help you God. Henry Smith Wm R. Jones John B. Brown deceased so far as I know or believe and that we will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charge me and that we will make a true and perfect inventory of all said goods and chattels so help me God.
