Beeks of the County of Pike and the State of Georgia make and publish this my last will and testament. Item 1st After paying my just debts - I give and bequeath to my sister Letitia A. Goodrich for her sole and separate use my Negro woman Nelly and her husband Gabe. Item 2nd After the death of my said sister - said Negro woman Nelly to go in like manner to my niece Cecelia Goodrich and after her death said Negro woman to go in like manner to my niece Ophelia Goodrich. Item 3rd I give and bequeath to my niece Ophelia Goodrich a Negro girl Isabel, eleven or twelve years old for her sole and separate use. Item 4th I give and bequeath to my niece Cecelia Goodrich a Negro girl child Mariah five or six years old for her sole and separate use. In the settlement of my estate I request my niece Cecelia to take Sopha and her children, the mother of Mariah, at a fair valuation in payment in part or all as the case may be of her interest in the same. Item 5th To my nephew William L. Goodrich I give and bequeath one thousand dollars. Item 6th To my nephews Walter C. Beeks and Eli Goodrich I give and bequeath one thousand dollars each in aid of their education. Item 7th After my death it is my will and I hereby direct my executors herein after named to sell all my property real and personal except the special legacies before mentioned, at such time as in their judgment the interest of my estate may require and after paying the money legacies, I direct 1st one fourth of the proceeds be set apart and the interest upon the same to be paid annually to my brother William A. Beeks during his life and I direct 2nd that the other three fourths be equally divided between all my nephews and nieces children of James A. Beeks and Letitia A. Goodrich except William M. Beeks who for reasons satisfactory to myself I hereby exclude from any participation in my estate. Item 8th The interest hereby given to my nieces is given to them for their sole and separate use free from all debts, liabilities and control of their husbands and the interest going to my nephews to be paid to them at their majority or sooner if deemed advisable by my executors. Item 9th The Negro man Gabe given to my sister Letitia A. Goodrich for her sole and separate use, it is my will that she have the privilege of selling him if she should desire to do so. Item 10th In the sale of my property, I request my executors not to sell my Negro man Emanuel and Milton away from their families. Item 11th After the death of my brother William A. Beeks, the fourth of my estate the interest of which he is to enjoy by the 7th Item of this will during his life, I direct to be divided as the remaining three fourths are _?_ of by the 7th item of this will. Item 12th I hereby appoint my brother James A. Beeks and my friend Henry Moor(?) executors of this my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this 31st day of October 1861. Gibson January Term 1863 of Pike Court of Ordinary Came into court at this regular term of the court, Charles H. Johnson and George W. White and being truly sworn depose that they saw John C. Beeks sign and publish the _?_ as his last will and testament while of sound and disposing mind that they witnessed the same for him at his request in his presence and of each other, and that the same was executed voluntarily by him on the day it purports to have been executed and that O.C.
