Item 1 I desire and direct that all my land be sold all my other property belonging to me and herein after disposed of and pay my debts and the balance to be disposed of as herein after named. Item 2 I give and bequeath to my beloved wife Nancy Hamil; Ellen a Negro girl about ten years of age and June about six years of age with all rights, members and _?_ to said Negroes free from all charges or limitations whatever to her own proper use, benefit and behoof forever with full power to dispose of the same at anytime previous or by will or deed , at her death , as she may think proper. The bequest made to my wife are (is) in line of her whole _?_. Item 3 I give and bequeath to my beloved wife for and during her natural life only, my Negro man Henry about twenty two years of age, Mary about twenty five years of age and her two children (to wit) John six years of age, Augustus about three years of age and as much of the household and kitchen furniture that she may want, two mules, horses, two cows and calves, five sheep, ten head of hogs, my buggy and provisions for one year and one third of the sale of my land. Item 4 I give and bequeath to my daughter Elizabeth S. Kindrick, the wife of Samuel L. Kindrick for her sole and separate use, for and during her natural life, free and exempt from the debts and liabilities of her present or future husband, a Negro man by the name of James about fifty five years of age, Wesley about twenty years of age. Item 5 I give and bequeath to my daughter Elizabeth S. Kindrick, wife of Samuel L. Kindrick, half of the property given to my wife during her natural life, after her estate therein is over, for her sole and separate use and during her natural life free and exempt from the debts and liabilities of her present or future husband and at the death of my daughter Elizabeth S. Kindrick to her children and I appoint my wife Nancy Hamil as trustee of the property herein given and bequeathed to Elizabeth S. Kindrick during her natural life and then to her children. Item 6 I give and bequeath to my son Willis Hamil for and during his natural life and after his death to his children the following property (to wit) Peter, a Negro man about twenty eight years of age, Winney, a girl about seventeen years of age and four hundred dollars to come out of the sale of this land and other property sold and one half of the property willed to my wife during her natural life ( after her estate therein is over). And I hereby will and constitute my wife Nancy Hamil his trustee in whom I hereby vest the legal estate to said property and her successors for the use of my said son Willis J. Hamil as aforesaid the use of said property to be alone enjoyed by the said Willis J. Hamil and not in any way to be taken in payment of his debts which he has already contracted or which he may hereafter contract. This July 21 1859 Clark (his mark) Hamil Signed delivered and published by Clark Hamil as his last will and testament in the presence of us the subscribers who subscribed our names hereto in the presence of said Testator at his special instance and request and of each other this July 21st 1859. Holsey do solemnly swear that we saw Clark Hamil sign seal publish and declare this writing to be and contain his last will and testament and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion and that we saw A.B.
