All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: D Hill dawnlfdp@yahoo.com December 1, 2003, 11:12 pm Source: Pike County, Georgia, Will Book D, page 234-235 Written: January 27 1893 Recorded: January 7 1896 Pike County, Georgia, Will Book D, page 234-235 Georgia Pike County} I James Yarbrough of said state and county do declare this as my last will and testament Item 1st I desire my body be buried in a decent manner after my death and my just debts paid Item 2nd I have given John W, Jas W, and S C Yarbrough three of my sons their share of my estate and also I have given my daughter Mary J Bussey she being now dead her share of my estate I have now two sons to wit: W C Yarbrough and T L Yarbrough whom I have not given their share in my estate Item 3rd I give my wife Sarah A Yarbrough all of my estate real and personal during her life, provided she survives me and after her death I desire my land to wit: lot No. 117 in the 8th District of said county to be divided between my said sons, W.C. and T.L. Yarbrough, as follows- by a direct line running north and south cutting said land in halves- and W C Yarbrough to have the west half of said lot, and T L Yarbrough the East half and I also desire my said two sons W C and T L Yarbrough to have my household and kitchen furniture and bedding after the death of my wife, if she survives me. Item 4th I desire and appoint W.C. Yarbrough to execute this my will after my death In witness whereof I James Yarbrough do hereby set my hand and seal to the foregoing as my last will and testament by marking my mark. This January 27th 1893. James Yarbrough (his mark) We the undersigned saw James Yarbrough make his mark for his signature and seal and declare the foregoing writing to be his last will and testament in presence of us who at his request in presence of each other have subscribed our name as witnesses hereto W F Childs J S Pope J J Moore State of Georgia County of Pike} Before me came J.S. Pope, named as a witness to the within writing purporting to be James Yarbrough's last will, being duly sworn says that he with W F Childs and J J Moore at the request of James Yarbrough and in his presence did attest as witnesses the within writing as his, James Yarbrough's will. That the same was signed by making his mark, and published by James Yarbrough in their presence, as his last will- That he was a the time of said attestation and signing by himself of sound and disposing mind and memory. That he executed the within paper freely & voluntarily J.S.
