Item 1st I give bequeath & devise to my beloved wife Amanda J Davis all of my property both real and personal and choses in action, for and during her life or during widowhood, should my wife marry again, I desire that my executor do sell all my property both real and personal and divide with all my children share and share and share alike my wife taking one share. Item 2nd If it should become necessary for my executor to sell any part of my property to pay any debt I owe at my death, I desire that my executor to sell only such real & personal property as can be sold so as to keep the estate as near intact as possible and that my executor sell such either publicly or privately as would be to the best interest of the estate. Item 3rd I desire to relieve my executor of making any returns after she shall qualify or applying for any orders to sell such of my estate as may be necessary to pay my debts if I have any at my death. Item 4th Learning that I have been made beneficiary under a will made by my Aunt who was the widow if Austin Davis Sr., now if any lands or money accrue to my estate under said will I desire that my executor manage the same in the name of my estate to the best of her judgement. Item 5th I nominate and appoint my wife, Amanda J Davis, executor of this my last will and testament without giving bond and making any returns or appraisement, after she shall qualify this Oct 18th 1910 Austin Davis signed sealed and published by Austin Davis as his last will and testament in the presence of us the subscribers who subscribe our names, hereto in the presence of said testator at his instance and request and of each other, he signing in our presence and we in his presence. C H Harper R C Mathews W M Hartley Georgia Pike County} Before me personally appeared W M Hartley named as a witness to the within writing purporting to be the last will of Austin Davis who being duly sworn, disposes and says that he with R C Mathews & C H Harper did on the 18th day of October 1910, did attest as witness the within writing in the presence of Austin Davis who in their presence voluntarily signed and published the same as his last will and that the said Austin Davis, was at the time of said attestation of signing of sound and disposing mind and memory. Sworn & signed before me Nov 7th 1910 J W Means Ordinary I do solemnly swear that the within writing contains the true last will of the within named Austin Davis deceased as far as I know or believe and that I will well and truly execute the same in accordance with the laws of this state so help me God.
