I James L. Winfield being of sound mind and memory though advanced in years, and knowing the uncertainty of the continuance of life, and the certainty of death, I therefore make and constitute this my last will and testament. Item 1st I will first that all my just debts be paid off. Item 2nd I give and bequeath to my beloved wife Mary Winfield all the land belonging to me for her homestead and special benefit and use during her lifetime and at her death to be divided but as she may think proper, and my wife Polly shall think proper to sell said lands at any time during her lifetime, she is to have the assets of said lands to purchase other lands, or otherwise appropriate for her use and comfort and at her death to be disposed of as she may think right. Item 3rd I also give and bequeath to my wife Polly one Negro boy named Charles about twenty five years old, and one Negro woman by the name of Minerva about twenty eight years old, and her three children viz Mathew, John and a little girl not named for her own special benefit and use during her life and then to be divided equally between our three children. Item 4th I also give and bequeath to my wife Polly all my stock of horses, mules, cattle and hogs, household and kitchen furniture, plantation tools of every kind, also two wagons, one buggy also the crop of every and any kind to be made on the same for the present year for the sustenance of the family and stock, and whereas my said wife Polly did some years past take her little grandson Viz James Edwin Gooch(?) to raise till he came of age, he being destitute of parents, and _?_ and without any means of support whatever , I therefore will that my said wife Polly shall continue to support, clothe and educate the said orphan J.E. Gooch(?) until he shall arrive at the age of twenty one years or so long as he will submit to her guidance and disciplines. I also will that one of my sons such an one as my wife may select take charge of the farming interest on said lands for a reasonable consideration but in the event that such services cannot be had, then my wife to employ some other suitable person whose services shall be paid out of each successful crop, and after paying all the debts against the estate which are created annually, then all monies, if any, is to be paid over to my said wife Polly in order to meet contingencies or dispose of otherwise for her special benefit and comfort in her declining years. Item 5th And whereas there is a portion of the property in my possession and which I only represent as natural guardian and trustee during my life, having been willed by John Jenkins in his lifetime to my said wife Polly for life time and then to her children and whereas a joint agreement has been made to give each one of our sons a boy out of the underwritten schedule as soon as they severally come of age , first James B. Winfield a boy named _?_ , twelve hundred dollars, to second son Wm. F.F. Winfield a boy named John to be given when he comes of age, also to _?_ Winfield one boy named Stephen to be given when of age. The schedule of the Negroes willed to my wife Polly her life time are as follows viz - Netty, forty years old, Bill, twenty six years old, Elizabeth, twenty five years old, Doll, twenty one, Wesley 19 years old, Moses, fifteen years old, Stephanie 13 years old, Martha 12 years old, John, 9 years old, Charles 4 years old, Netty 2 years old, Cap(?) 1 year old. Never the less my said wife Polly is at liberty to make such other distribution of the effects named in this item as she may think best when the children come of age and settle themselves in life. Item 6th I do hereby constitute and appoint my wife Polly Winfield executrix and my son James L. Winfield executor of this my last will and testament. Holmes Georgia Pike County We Thomas Dumas, Shadrack Holmes and Wm C. Holmes do solemnly swear that we saw James L. Winfield sign, seal and heard him publish and declare this writing to be and contain his last will and testament and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion, to the best of our knowledge and belief and that we signed the same in the presence of each other and the Testator and that we did it at the request of the Testator. Winfield do solemnly swear that this writing contains the true last will and testament of James L. Winfield deceased so far as we know or believe, that we will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges us and that we will make a true and perfect inventory of all such goods and chattels so help us God.
