Holmes of said State and County being in infirm health, far advanced in years and _?_ with the importance of _?_ to my beloved wife and children my tender regards for their welfare and being also in possession of a sound and disposing mind and memory do make and ordain the following as my last will and testament. Item 1st It is my wish and desire and I do hereby give and bequeath unto my beloved wife Mary H. Holmes a certain Negro woman Lucy and her boy child Sanford together with her bodily increase. Item 2nd It is my wish and desire and I do hereby provide that every one of my beloved children shall fare alike in the distribution of my earthly estate and that my daughter Harriet N. Hartsfield has heretofore as I conceive, received twenty seven hundred dollars more than either of her other sisters. Item 3rd It is my wish and desire and I do hereby provide that each of my beloved daughters Mary J. Jordan, Malinda N. Mangham do each receive the sum of twenty seven hundred dollars to make them equals as I conceive, with their younger sister Harriet N. Hartsfield and that said sums to be received out of any of my Negro property not set apart in Item first, to be ascertained by apportionment or valuation. Item 4th It is my wish and desire and I hereby provide that if there should be more of my Negro property than it takes to make my daughters Mary J. Jordan and Malinda N. Mangham equal with their younger sister, then the remainder of said property to be equally divided between my three daughters, and if it is found that said property is not enough to make my daughters Mary L. Jordan and Mailnda N. Mangham equal with their younger sister then they are to be made equal out of any other effects that belong to my estate not heretofore set apart in item first. Item 5th It is my wish and desire and I do hereby provide that all my lands, stock and all my other property be sold by my executors, either publicly or privately, as they in their judgment deem best and that the proceeds after the provisions of item fourth, if any should be needed, to be equally divided between my beloved wife and three daughters. Item 6th It is my wish and desire and I do hereby appoint Wiley E. Mangham, John J. Jordan, and Thomas I. Hartsfield as my executors. James C. Holmes (his mark) P.H. McDowell John P. Garner John J. Cox _?_ Carriker(sp) Georgia Pike County Court of Ordinary May Term 1861 Personally came into open court, John Garner, John J. Cox and P.H. McDowell, who being duly sworn, dispose and say that they saw James C. Holmes sign seal and publish the within as his will and testament while of sound disposing mind and memory, that they witnessed the same for him at his request made in his presence and in the presence of each other, and that the same was executed voluntarily by him some time in January in the year 1859. Holmes deceased as far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods and chattels will thereunto extend and the law charges me, and that I will make a true and perfect inventory of all such goods and chattels, so help me God.
