Butler of the County and State aforesaid do make publish and declare this writing to contain my last will and testament. Item 1 I will that all my just debts be paid Item 2nd My will wish and desire is that after the payment of my just debts that the whole of my property be the same real personal or mixed be divided equally between my wife Julia A. Butler and Mary J. Butler our daughter and that portion going to my wife Julia A. Butler to be hers during her lifetime not subject to the debts or liabilities of any future husband and upon the death of my said wife the whole of that portion of my property herein bequeathed to her to go to and be absolute property of my daughter Mary J. Butler free from the debts liabilities or contracts of any husband she may marry and the property above bequeathed to my said daughter in like manner is to be her separate property free and exempt from the debts contracts or liabilities of any husband she may have. Item 3 My will wish and desire is that my friend Daniel G.S.(?) Ballard be qualified as my Executor to carry out this my will with power to divide my property without sale in such manner as directed and may be deemed advisable by him and the Ordinary of the County In witness(?) whereof the said John W. Butler has hereto set his hand and seal this 13th day of August 1862. J.W. Butler Signed sealed and published by John W. Butler as his last will and testament this 13th day of August 1862. H. Green W.B. Ballard J.T. Huguley Georgia Pike County We H. Green, W.B. Ballard and J.T. Huguley solemnly swear that we saw John W. Butler sign and seal and heard him publish and declare this writing to contain his last will and testament and at the time thereof he was of sound disposing mind and memory and that he signed the same freely and voluntarily without any Compulsion to the best of their knowledge or belief and that we signed the same in the presence of each other and in the presence of this Testator. Ballard do solemnly swear this writing contains the true last will of the within named John W. Butler deceased as far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charge me and that I will make a true and perfect inventory of all such goods and chattels so help me God D.G.S.
