I Colson Moreland Sr. of said State and County being of advanced age and knowing that I must shortly depart this life deem it right and proper that I should make a disposition of the property with which a kind Providence has blessed me, I do therefore make and ordain this my last Will and Testament hereby revoking all others heretofore made by me. Item 1 I desire and direct that my body be buried in a decent and Christian like manner. Item 2 I will and desire that all my just debts if any be first paid by my executors without delay. Item 3 I give, bequeath and devise unto my beloved wife Leah Moreland during her natural life or widowhood my houses and two hundred acres of land surrounding the same, together with all the household and kitchen furniture that she may wish to keep for her own comfort and all the stock belonging to the farm that she may need for carrying the farm. Also four of my Negroes (to wit) a woman named Biddy, a young man named Elbert, a young named Eli, and a boy named Berry, and at her death or in case she should marry, in either case the rights and title of the above said land with the _?_ and _?_ shall go to and vest in my two sons (to wit) Colson T. and William A. Moreland and the above named four Negroes given to my wife Leah at her death or marriage go to my three children Martha Jane Walker, Colson T. Moreland and William A. Moreland and they shall pay over to the three other heirs to wit - Mary F. Hines, Cynthia Ann Taylor, and my grand daughter Mary J. Alexander and her children, Daughter of Peninah E. Alexander deceased, one half the value of said four Negroes at a reasonable valuation each one sharing equally. Item 4 I will and bequeath unto my two sons the residue of my land being in the aforesaid County to wit - four hundred acres more or less it being a part of the balance of my tract of land given to my wife in Item 3rd together with all the right and _?_ thereunto belonging. Item 5 I have already given to each of my children the following named Negroes To Peninah E. Alexander a Negro named Ester, to Mary F. Hines two Negroes Ann and Evans to Cynthia A. Taylor two Negroes Render and Arnold, to Martha Jane Walker two Negroes Martha and Louisa, to my son Colson T. Moreland two Negroes Charles and Lurany(?), to my son William A. Moreland two Negroes Augustus and Russel as their own right and property, the residue of my Negroes of which I may die possessed it is my will and desire that they be divided by valuation into six lots and each one of my five children above named shall receive one lot or one sixth part of said Negroes according to valuation and my granddaughter Mary J. Alexander and her children Daughter of Peninah E. Alexander deceased shall receive one share or one sixth part of said Negroes by valuation. Item 6th I will and bequeath unto my sons Colson T. and William A. Moreland my Negro man Isham to take care of him during his life. Item 7th All else of my perishable property not otherwise disposed of shall remain on the place and belong to my sons Colson T. and William A. Moreland. Item 8th I hereby constitute and appoint my two sons Colson Y. Moreland and William A. Moreland executors to this my last will and testament this 8th day November 1862. Colson Moreland Signed sealed published and declared by Colson Moreland Sr. as his last will and testament in the presence of us the subscribers who have subscribed our names hereto in the presence of said testator and of each other this 8th day of November 1862. David R. Steger Charles F. Redding Zachariah Sims Georgia Pike County Court of Ordinary March Term 1863 The will of Colson Moreland being produced in open court for probate by the executor who has filed his petition to prove the same and the witness to said will Charles F. Redding having subscribed the following affidavit _?_ on said will came into open court at this regular term of the court, Charles F. Redding and being duly sworn dispose that he saw Colson Moreland sign and heard him publish the writing as his last will and testament while of sound and disposing mind and that he signed the same for him at his request and in his presence and each others and that the same was executed voluntarily by him on the day it purports to have been executed. Charles F. Redding Sworn to and subscribed before me in open court March Term 1863 Georgia Pike County I do solemnly swear that this writing contains the true last will of the within named Colson Moreland deceased so far as I know or believe and that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charge me and that I will make a true and perfect Inventory of all such goods and chattels so help me God.
