I Foster Freeman of the said State and County being of sound mind and advanced age and knowing that I must shortly depart from this world deem it right and proper both as respects myself and family that I should make a disposition of the property with which a kind providence has blessed me. I therefore make this my last will and testament hereby revoking all others heretofore made by me. Item First I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition, my soul I humbly trust shall return to God who gave it as I hope for eternal salvation thru the blessed Lord and Savior Jesus Christ whose religion I have professed and as I humbly trust enjoyed for the period of a number of years. Item Second I desire and direct that all my just debts be paid without delay by my beloved wife Nancy with the assistance of my two beloved sons Francis and James with the funds belonging to my estate, where collections if not sufficient _?_ money in hand at the time of my decease as I am unwilling that my creditors should suffer from delay in want of their rights. Item Third Having heretofore give unto my elder children their _?_ portion of my estate, I proceed to divide the balance between my wife and my two sons Francis and James as follows. To my beloved wife Nancy with whom I have lived in the strictest quiet and love for a period of a number of years, I give and bequeath the west half of lot of land (N.76) seventy six in the (2) Second District formerly Monroe now Pike County containing one hundred and one quarter acres more or less the place whereon I now live with all the rights members and apperations to said lot of land during her widowhood or natural life and I also direct that at the intermarriage or death of my beloved wife Nancy said half of lot of land above described with all the rights members and apperations thereto belonging shall be and go to my beloved son James D. Freeman. Item Fourth I give and bequeath unto my beloved wife Nancy during her widowhood or natural life all my farming utensils of any description my household and kitchen furniture, my carriage and horse, stock of poultry, horses, mules, cows, calves, oxen, sheep and hogs, with all the produce on the plantation at my decease, together with all the ready money and notes in my possession at the time of my decease after any just debts are paid for the use of her and her family and I further direct that at the intermarriage or death of my beloved wife, that all the faming utensils of any description, household and kitchen furniture, carriage and horse, stock of poultry, horses, mules, cows, calves, oxen, sheep and hogs with all the produce of the plantation at the time of the decease or intermarriage of my beloved wife Nancy together with all the ready money and notes in her possession at the time of her decease _?_ shall be equally divided between my two beloved sons Francis and James D. Freeman. Item Fifth I give and bequeath to my beloved wife Nancy during her widowhood or natural life my Negro man Sam and Negro woman Tabitha with her future increase and at the intermarriage or death of my beloved wife Nancy the aforesaid Negro man Sam and Negro woman Tabitha with her increase shall be equally divided between my two beloved sons Francis and James D. Freeman. Item Sixth I give and bequeath unto my beloved wife Nancy during her widowhood or natural life my Negro woman Harriet with her future increase and at the intermarriage or death of my beloved wife Nancy the aforesaid Negro woman Harriet with her future increase shall go to my beloved son James D. Freeman. Item Seventh Being desirous that there be no difficulty _?_ or administratorship (sp) in regard to the distribution of my little estate after my decease, I hereby appoint and constitute my beloved wife trustee together with my two beloved sons Francis and James to the management of said Estate till the intermarriage or death of my beloved wife Nancy. Then I desire that my two beloved sons Francis and James so divide said estate according to this my last will and testament. Signed sealed and declared by Foster Freeman as his last will and Testament in the presence of us the subscribers who subscribe our names hereunto in the presence of said Foster and of each other this sixteenth day of June 1846.
