Holsey of said county do make declare and publish the following writing to contain my last will and testament. Item 1st I will that all my just debts be paid. Item 2nd My will wish and desire is that upon my death all my property of what kind _?_ be the same real personal or mixed be kept together by my wife Elizabeth Holsey and managed by her for her use and the use of our children for and during the lifetime or widowhood of my said wife and upon her marriage all my property to be equally divided between her and our children share and share alike and should she die without marrying again then and upon that event all my said property to be equally divided among our children born and to be born the fruits of our marriage. Item 3rd I constitute and appoint my wife Elizabeth Holsey to carry this my will into effect and that she have leave to sell and depose of any of my property at public or private sale as she may think best and to purchase such property for said estate as in her judgment may be expedient and proper without being required to obtain any order of the court for that purpose or without being required by law to make any return of her proceedings as said Executrix. In witness whereof I the said Robert F. Holsey have hereunto set my hand and offered my seal this the 2nd day of June 1862. Robert F. Holsey sign seal and heard him publish and declare the foregoing writing to contain his last will and that we signed the same as witnesses in his presence and in the presence of each other at the request of the said Robert F. Huckaby and Peyton F. Horton and being duly sworn depose and say that Robert F. Holsey sign and sealed the foregoing instrument in their presence and they heard him declare the same to contain his last will and testament that he signed the same freely and voluntarily and that he was of sound disposing mind at the time that they signed the same at his request as witnesses in his presence and in the presence of each other on the day it purports to be executed sworn to and subscribed in open court this 12th January 1863 William F. Jackson Edward N. Huckaby Peyton F. Horton May Term Court of Ordinary of Pike Co. 1863 The within will of Robert F. Holsey of Pike Count having been sworn at this January term of this court 1863 by the oath of the subscribing witnesses it is ordered that said will be admitted to record and that Letters Testamentary issue to Mary E. Holsey the executrix named in said will upon her taking the oath prescribed by Statue Z. Sims Ordinary Georgia Pike County I Mary E. Holsey do solemnly swear this writing contains the true last will of the within named Robert F. Holsey deceased so far as I know or believe that I will well and truly execute the same by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereunto extend and the law charge me and that I will make a true and perfect inventory of all such goods and chattels so help me God Mary E.
