First I will and direct that all my just debts be paid and discharged as soon as possible. Second I will devise and bequeath unto my dear wife Elizabeth Curtis the following named Negroes to wit - Sandy an Negro boy about fifteen years of age and June a Negro girl about twelve years old and also the homestead and plantation where I now reside consisting of lots of land number Fourteen (14) part of Lot number fifteen (15) Lots number sixteen (16) and thirty five (35) and part of Lot number thirty seven (37) all being in the north district of originally Monroe now Pike County aforesaid together with all my household and kitchen furniture, the choice of one horse and one mule that I may own at the time of my decease and of two cows and their calves to be selected by her also my rockaway and harness, all my stock of hogs and provisions and meat sufficient for one year after the division or sale of my Negroes. In case my said wife should intermarry then to have the use and benefit of part of Lot number fifteen (15) and Lot number sixteen (16) to hold the same and the profits thereof after my debts are paid to the said Elizabeth Curtis for and during the term of her natural life and after the death of my said wife the above property bequeathed to her shall go and be enjoyed by the persons herein after mentioned and in this way and manner and condition herein after mentioned. Third I will devise and bequeath one seventh part of all my estate real and personal unto my son Charles H. Curtis to hold to him and his heirs forever. Fourth I will devise and bequeath one seventh part of all my estate real and personal to my son William K. Curtis to hold to him and his heirs forever. Fifth I will devise and bequeath one seventh part of all my estate real and personal unto my son Elijah S. Curtis to hold to him and his heirs forever. Sixth I will devise and bequeath unto my son John C. Curtis one seventh part of all my estate real and personal to hold to him and his heirs forever. Seventh I will devise and bequeath one seventh part of all my estate real and personal unto my Executor herein after named and the survivors and survivors of them in trust and only in trust to and for the sole and separate use benefit and behoof of my daughter Francis H. knight - wife of David Knight for and during her natural life not subject to the debts or control or contracts of her present or any future husband and after her death to be divided among the children share and share alike their heirs and assigns forever. Eighth I will devise and bequeath one seventh part of all my estate real and personal unto my Executors herein after named and the survivors and survivors of them in trust and only in trust to and for the sole and separate use benefit and behoof of my daughter Sarah C. Blankinship for and during her natural life not subject to the debts of any future husband or his control or contracts and after her death to be divided among or to her child or children share and share alike his her or their heirs and assigns forever. Ninth I will devise and bequeath one seventh part of all my estate real and personal unto my Executor herein after named and the survivors or survivors of them in trust and only in trust to and for the sole and separate use benefit and behoof of my daughter Susan H. Curtis notwithstanding any future coverture for and during her natural life and after the death to any child of children his her or their heirs and assigns forever. Tenth I will that the children of my daughters shall share and share alike at the death of the parent and that should either of them die before the parent leaving a child or children such child or children shall be entitled to the portion of their deceased parent. Eleventh I do hereby appoint my sons Charles H. Curtis, William K. Curtis, Elijah S. Curtis and John C. Curtis executors of this my last will and testament. In writing whereof I have hereunto set my hand and affixed my seal this the fourteenth day of April one thousand eight hundred and fifty seven. Caleb Curtis Signed sealed declared and published by the Testator Caleb Curtis as and for his last will and testament in the presence of us and of each other who have subscribed our names thereto as witnesses at his request and in his presence and in the presence of each other this 14th April 1857 Jas Eppinger John N. Mangham A.B. Vaughan Georgia Pike County Before me came on the 6th March 1863 at chambers for the purpose of having the last will and testament of Caleb Curtis, John N. Mangham one of the witnesses and the will having been before that time brought before me for probate by the Charles H. Curtis who has filed his petition for probate of the same, he the said witness depose of the same that he saw said Caleb Curtis sign and heard him publish the same as his last will and the day and near then stated as executed by him that he witnessed the same at his request in his presence and in presence of each other that the same was voluntarily executed by him while he was of sound and disposing mind and memory. J.N. Mangham Sworn to and subscribed before me this 6th day of March 1863 Z. Sims Ordinary October Term 1863 The within will of Caleb Curtis having been proven in vacotion(?) by the oath of John N. Mangham on the sixth day of March 1863 On motion it is ordered that the same be admitted to record and that Letters Testamentary issue to Charles H. Curtis one of the executors nominated and appointed in said will upon his taking the oath required by law. Z.
