I John H. Milner of the county and state aforesaid being of sound disposing mind and memory and desirous of availing myself of the privileges the law allows me of disposing of the estate with which my Heavenly Father had blessed me, after my decease do make this my last will and testament hereby revoking all former wills by me at any time made in manner following, that is to say Item 1st I will that all my just debts be paid out of my present crop. Item 2nd I will devise and bequeath unto my beloved wife the following property to wit- Negroes Abram and his wife Lydia, Isaac and his wife Milly, Lucy and Malinda, together with my home and all my household and kitchen furniture and all my stock of every kind and my carriage and buggy, wagon and carts and all this crop except the cotton crop - and all my plantation tools and implements. To have and to hold to her own proper use, benefit and behoof for and during her natural life and no longer subject to the charges and encumbrances hereafter made them on item fourth of this my will. Item 3 I account it that I have heretofore given and advanced to my daughter Susan Putnam, wife of James Putnam, in property and _?_ , including a Negro girl Maria, now loaned to her, seventeen hundred dollars, and to my son George W. Milner, in property, about eighteen hundred dollars, and to my son Pitt Milner, in property and cash, nineteen hundred dollars, and to my daughter Apasla(?) Ann Beckham, wife of Solomon Beckham, in property, seventeen hundred dollars, and to my daughter Elizabeth S. Eppinger, widow of John Eppinger deceased, in property and money eleven hundred dollars, and to my daughter Eliza P. Wood, wife of Isaac Wood, in property and including the Negro boy William, now loaned to her seventeen hundred dollars - and(?) my will is that my said children above mentioned as advanced receivers and none of my estate until on the final revision thereof after the death of my wife as hereafter mentioned except cash enough out of the crops to make them all equal in valuation to my son Pitt. Item 4 I will that all the balance rest and residue of my estate to by my wife and Executors kept together and worked as now for and during the life of my wife and my will is that as each of my children Martha Rowena Milner, Jonathan James Milner, Richard Willis Milner. Mary Jane Milner, Rebecca Amorette Floretta Milner shall marry or settle off to themselves as they wish, they shall receive and be advanced by my executors out of any of my said property and _?_ except my plantation lands equal in valuation to what I have given my son Pitt above mentioned and no more until the final division after my wife’s death. But my son Jonathan J. and Richard W. if they wish it may work any of my land free of rent. Item 5 I will that my executors sell in any way they decide best at either public or private sale any lands I may own except my home plantation near Zebulon in Pike County except my interest in lands in Randolph County, Alabama which last I have given to my old _?_ Joshua S. Item 6 I will that after the death of my wife, my home Plantation near Zebulon in Pike County to by my executors sold at public or private sale in a body and of thought(?) _?_ by them in their annual installments; and that there the whole residue of my estate, including the remainder of what I have herein given my wife for her life and also whatever may be coming to me from the estate of my deceased Father or otherwise after making all my children equal above mentioned, be equally divided among all my children or their representatives share and share alike, except that if any of my daughters should die before said division leaving no child or children then the husband or representative of such daughter so dying without leaving children living at her death to have no further part or share of my estate on said division but that the part or share that would otherwise be remaining to her be equally divided among the rest of my children. Item 7 I will that all the part or share of my estate which shall be coming to my daughter Susan Putnam wife of James M.(?) Putnam, including the Negro girl Maria now loaned to her, be _?_ in and remain in my son George W. Milner as Trustee for the sole and separate benefit and behoof of my said daughter and her children forever free from the control, debts or contracts of her present or any future husband with power(?) her and Trustee to manage the same as to her may seem best for my said daughter. Item 8 I hereby appoint my son George W. Milner and my son in law Solomon C. Beckham executors of this my last will and testament and request of them to accept the appointment and in which thing I have hereto set my hand and affixed my seal this the 1st November 1851 (see note) John H. Milner late of said county deceased do solemnly swear that I saw John H. Milner sign seal and heard him publish and declare this writing to be and contain his will and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of his knowledge and belief and that I saw David K. Montgomery and William W. Arnold sign the same as witnesses and that we signed the same in each others presence and in the presence of and at the request of the testator.
