All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Bill Russell dragonraj@comcast.net September 29, 2004, 12:33 pm Source: Pike County Probate Court Written: December 21 1837 Recorded: January 6 1840 Will of Frederick Daniel Georgia Pike County In the name of God Amen I Frederick Daniel of said State & County being weak of body but of sound mind & disposing memory & knowing that it is appointed for me to die, do make this my last will & testament Item the 1st It is my will & desire that after my decease that my executor shall have my body buried in a decent & Christian like manner Item 2nd It is my will that all my just debts shall be paid out of the proceeds of my estate Item 3rd I give and bequeath unto my son Penter [?] Daniel widow’s children the sum of one hundred dollars in money Item 4th I give and bequeath unto my Granddaughter Elizer R. Merritt the sum of one hundred dollars Item 5th It is my will that Joseph Daniel the son of my deceased son Lunsford R. Daniel shall have no part or interest in any of my Estate either real or personal Item 6th I give and bequeath unto my daughter Nancy Giles & her children the sum of one hundred dollars Item 7th I give and bequeath unto my son James Daniel four hundred dollars in loo [sp] of a negro boy by the name of Dan which I hereto give to him at my death but for the above sum sold back or relinquish to me which boy I have sold to my son Egbert P. Daniel the above sum of four hundred dollars my son James is to have over and above his distributive share of my property Item 8th I do hereby give and bequeath unto my sons Isaac Daniel, James Daniel, & Egbert Daniel and my daughters Susan Dimukes & Elisabeth Merritt all the remainder and residue of my property both real and personal after paying my just debts my funeral expenses and satisfying the above mentioned Legacies to be equally divided between the said Isaac the said James the said Elbert P. the said Susan and the said Elisabeth Item 9th And I do hereby appoint my sons James Daniel and Egbert P. Daniel executors of this my last will and testament to carry the same into complete execution and I do hereby declare & publish this to be my Last will & testament hereby revoking all other wills heretofore by me made. This I make sign seal declare & publish on the twenty first day of December in the year of our Lord one thousand eight hundred and thirty seven on the day and year aforesaid Frederick Daniel his mark Signed sealed published and declared in presence of Jacob Martin T. T. Atkinson G. J. Green Simon Waller [?sp] his mark Georgia Pike County Georgia Court of Ordinary January Term 1840 The last will & testament of Frederick Daniel at this regular term in open court upon the oath of Jacob Martin T. T. Atkinson & Simon Waller ordered that the same be admitted to record Georgia Pike County I James Daniel, Egbert P. Daniel do solemnly swear that this writing contains the true last will of the within named Frederick Daniel deceased so far as we know or believe & that we will ewll and truly execute the same by paying first the debts & then the Legacies contained in said will as far as his goods and chattels will thereunto extend & the law charge us & that we will make a true & perfect inventory of all such goods and chattels so help us God Egbert P.
