Martin In the name of God Amen I Joshua C. Martin of the County of Pike and State of Georgia being of sound and disposing mind and memory and being desirous to settle my worldly affairs while I have strength so to do, do make and publish this my last will and testament hereby revoking all wills by me heretofore made: And first I commend my soul to the God who gave it, and my body I desire to be buried according to my circumstances in life, and my worldly estate I dispose of as follows First I hereby appoint my Brother Elijah F. Martin and my wife Mary Idella Martin Executor and Executrix of this my last will and testament Second It is my will that my Executor and Executrix have full authority to manage my estate as they may think best for the interests of all Legatees with the privilege of buying and selling whatever may be to the interest of all the parties concerned and that the proceeds of the estate made by farming or otherwise be applied to the support of my family and the education of my children Third I desire that each child on coming of age or marrying a man who is of age, shall receive an equal proportion or child’s part of the Estate, and that my wife shall have a child’s part of said Estate, which is to be taken in lieu of her dower in the lands of which I may die seized and possessed ; and in case she elects to take her dower, she hereby relinquishes her legacy under this will Fourth In case my wife shall die or marry before this will is fully administered, then it is my desire the said Elijah F. Martin become sole Executor of this will, and that he become the Guardian of such of my children as are not of age. Fifth It is my will that my said Executor and Executrix shall be free from all legal requirements, expenses and legal proceedings from which I have the power to relieve them by will. In case the said Elijah F. Martin should die before my said wife, then it is my desire that she shall take upon herself the whole execution of this will during her life or widowhood, but should she have married before the death of the said Elijah or should she die or marry after the death of the said Elijah and before this will is fully executed and administered I desire that there be appointed an administrator de bonis [?] With the will annexed On witness whereof I the said Joshua C. Martin have to this my will consisting of one sheet of paper set my hand and seal this third day of September 1874 Signed, sealed, published and declared by the above named Joshua C. Martin as his last Will and Testament in presence of us who at his request in presence of each other have subscribed our names as witnesses hereto D. N. Martin [sp] P. Burks R. P. Calwell Georgia Pike County Before me came on the 7th day of July 1875 at chambers for the purpose of proving the last will and testament of Joshua C. Martin one of the subscribing witnesses to said will viz. David N. Martin and the will signing [--?--] before that time brought before me for probate by the executor Elijah F. Martin and Mary I. Martin Executrix who have filed a petition for probate of the same. He the said witness depose of the same that that he saw said Joshua C. Martin sign and heard him publish the same as his last will on the day and year then stated, as executed by him that he witnessed the same at his request in his presence and in the presence of the other two witnesses that the same was voluntarily executed by him, while he was of sound disposing mind and memory and also P. Burk and R. P. Calwell sign the same as witness in the presence of Testator at his instance and request D. N. Martin Sworn to and subscribed before me this July 7th 1875 T. J. Blasingame Ordinary Georgia Pike County We Elijah F. Martin and Mary I. Martin Do solemnly swear the within writing contains the true last Will of the within named Joshua C. Martin deceased so far as we know or believe and that we will well and truly execute the same in accordance with the Laws of this State so help us God E. F. Martin D. N.
