Item 1st I will and devise that my body be buried in a Christian like manner and respectable manner. My soul will I trust return to God who gave it as I trust in redemption through his son whose Religion I have professed and Ihope enjoyed for the last thirty years. Item Second I will and devise that all my legal creditors be paid their just debts as there is no necessity cause for delay. Item 3rd I will and devise to my beloved wife Milly Davison for and during her natural life or widowhood the lot of land on which my dwelling house is situated, also the following negroes Tilsman and Ann, also two bedsteads Beds and Bed clothing of her own choice. Also one mule of her own choice. Also two milk cows of her own choice with calves, all the above for her use only, at her death to be reverted back to my heirs hereinafter named. Item 4th I will and bequeath to my Grand children by my daughter Ann Kelly each [marked thru] five hundred dollars to be paid to them by my Executor hereinafter named as each one becomes of the age of twenty one years old. Five hundred dollars apiece. Item 5th I will and bequeath to my Grand daughter Laura Murcherson for her own use and benefit and her children after her five thousand Dollars and in case she should die without issue of being married said sum shall revert back to my heirs hereinafter named and I hereby appoint my son William H. Davison as her trustee for the appropriation of said sum. Item 6th All of the rest of my property both real and personal I give and bequeath to my sons William H. Davison James Davison and Cullen Davison to be equally divided amongst them Item 7th I constitute and appoint each of my sons William, Cullen and James Davison as my Executors to this my last Will & Testament Interlined [?] before signing In witness whereof the said Talbot Davison has hereto set his hand and seal this March 2nd 1863 Talbot Davison his mark Signed sealed & declared by the said Talbot Davison to be his last Will and Testament in our presence who signed the same as witnesses at his request in the presence of the Testator and in the presence of each other this the day and date above written A. J. Williams Micajah B. Pickely F. H. Cleves Georgia Pike County I A. J. Williams do solemnly swear that I saw Talbot Davison sign seal and heard him publish and declare the foregoing writing to be and contain his last Will and Testament and at the time thereof he was of sound disposing mind and memory and that he did it freely without compulsion to the best of my knowledge and belief and that I signed said Will in the presence of the said Talbot Davison and that I saw Micajah B. Pickely and F. H. Cheves the other two witnesses sign the same as witnesses in the presence of [each other marked out] Testator and in presence of each other on the day and year it purports to have been executed A. J. Williams Sworn to and subscribed before me in open court this the 3rd day of January 1876 T. J. Blasingame Ordinary Georgia Pike County I Talbot Davison being convinced that I am rapidly declining in health do make and declare this codicil to the foregoing Will revoking all else besides. Item first I am satisfied with and declare it to be a portion of this Codicil. Item Second I am satisfied with and declare it to be a portion of this Codicil and of full effect. Item third my beloved wife Milly having gone to God, there is no use of that item. Items fourth & fifth, I am satisfied with and constitute them a portion of this Codicil. I also will and bequeath to my daughters in law America Davison widow of my deceased son Joshua C. Davison two hundred dollars to be paid to her after my death by my Executors and also commend her to my children and trust that they will never neglect her or forget her kindness to me . With Item sixth of my will I am satisfied and incorporate it fully in the codicil. With Item 7th I am also satisfied and I redeclare constitute and appoint my sons William, Cullen and James Davison my Executors to this my last Will and Testament To insure a speedy probate of this Will I reiterate all I have written in this Codicil declare it to be my last Will and Testament revoking all others. In witness whereof I have hereunto set my hand and affixed my seal this eighteenth day of September 1875 Talbot Davison his mark Signed sealed in presence of Testator & in presence of each other Jas. Blasingame Ordinary in and for said County came on the 6th day of October 1875 at Chambers for the purpose of proving the last Will and Testament of Talbot Davison two of the witnesses to said Will or Codicil namely James W. Simmons & J. C. C. Blackburn and the Will having been before that time brought before me for probate by one of the Executors Wm. H. Davison who has filed a petition for probate of the same they the said witnesses depose of the same that they saw the said Talbot Davison sign and publish the same as his last Will on the day and year therein stated as executed by him that they witnessed the same at his request in his presence and in presence of each other, and that they saw William P. Wright sign the same as witness in the presence of Testator and in their presence that the same was voluntarily executed by him while he was of sound disposing mind and memory James W. Simmons J. C. Blasingame Ordinary Pike Court of Ordinary January Term 1876 Ordered by the Court that the Will of Talbot Davison and codicil of the same be admitted to record as satisfactorily proven in common form and that the Executors W.
