All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Bill Russell dragonraj@comcast.net October 3, 2004, 12:26 pm Source: Pike County Probate Court Written: October 23 1828 Recorded: October 3 1829 Will of Moses Smith In the name of God Amen I Moses Smith of the State of Georgia & County of Pike being in low state of bodily health but of sound mind and memory calling to mind the mortality of my body do make and ordain this my last will & testament in manner & form following (viz) Item first I will and bequeath that all my just debts be paid Item 2nd That my children have a reasonable education at the discretion of my Executor 3rd I will that wife Lucinda receive of my property one hundred & sixty dollars. Likewise an infant with which she is pregnant, provided it is born & lives till a division of the estate, to receive the same amount above named if it should not be born & live till such a division said sum be divided among all my lawful heirs. 4th I will and bequeath to my son John one hundred & sixty dollars 5th I will to my son Henry one hundred & sixty dollars 6th I will to my son Joseph one hundred & sixty dollars 7th I will to my son Vincent A. Tharp one hundred & sixty dollars 8th I will to my son Ragan one hundred & sixty dollars 9th I will to my daughter Sally one hundred & sixty dollars 10th I will to my daughter Lucetta one hundred & sixty dollars 11th All this to be done as quick as it can be done of the products of my plantation & they shall become of age; if they shall keep the property from wasting [?] & if not to beat the discretion of the executors & the above named legates to make said legacies equal with my daughter Elizabeth Hambrick who I [--?--] has received that amount 12th I appoint my brother John A. Tharp as a lawful guardian for all my children so far as to receive my legacy coming to me from the estate of Vincent Allen Tharp & the estate of Henry Smith & do distribute it equally among my lawful Heirs 13th I will that when all the above legacies are paid off if my executors think it expedient to sell my land & [--?--] & all my stock household & kitchen furniture I direct [?] him to do so but I desire that all my children & wife [--?--] may live single, live together on my plantation provided they can do so in peace & be supported by the [--?--] & negroes & stock excepting my daughter Elizabeth Hambrick who has left me, but should my wife desire to have my plantation, I will that she take my two daughters Sally and Lucetta & raise them & that she be paid a reasonable amount for the same by my executors of my estate if she should raise them in a proper & decent manner if not they are at the [--?--] of my executor, likewise I wish my other minor children namely Henry, Vincent A. Tharp, Joseph, Moses Ragan to live with & be under the direction of my son John provided my wife should leave them & they should fail to continue together on my plantation. But if they will not submit to this order as to be under the control of my executors [--?--] if my wife cant [sp] control my daughters I desire them to live with my son John so long as he can control them then & be supported as the others from my plantation 14th I will that when all the above legacies are paid off or at any time my executors think the Estate is wasting [?] that the land negroes stock household & kitchen furniture and all my estate both real & personal be sold & the proceeds equally divided among the following legates (viz) my wife Lucinda & the infant with which my wife is pregnant provided it is born & lives - my son John, Henry, Vincent A. Tharp, Joseph & Moses Ragan, my daughters Elizabeth Hambrick, Sally & Lucritia 15th I will that my son John, my brother John A. Tharp & William V. White be the sole executors of this my last Will & testament revoking all former wills by me made.
