Yarbrough Georgia Pike County In the name of God Amen I John A. Yarbrough while in health & possessing a sound & disposing memory knowing my children & property & the duty I owe them & also knowing that it was appointed unto man to die & desiring now to dispose of my earthly possessions do make and ordain this my last Will and testament revoking all other wills that may have been heretofore made. Item 1st It is my will and desire that all of my just debts be paid by my Executrix as soon after my death as possible. Item 2 I will and bequeath to my beloved wife Mary A. Yarbrough during her life or widowhood all of my estate real personal & mixed, chosen in action & money, directing her to keep said property together for the purpose of raising and educating my children with power to sell or exchange any part of said property & invest the proceeds in other property for her benefit & the benefit of my children as hereafter explained without procuring an order of Court or consent of a chancellor her letter to be as perfect as if made by myself while in life. Item 3 It is my will and desire that if my wife should again marry that all of my estate to be equally divided between my children born & to be born & my said wife share & share alike & if she should survive until my oldest child arrives at full age then I desire that said child shall be advanced an amount equal to his share of my estate & that the said Executrix and said child shall each select a friend to make the division in kind, if possible & if that cannot be done in money by the sale of such property as will least [-- ?--] the balance of estate by my said Executrix & it is my further desire that each child shall be advanced in like manner as they arrive of age, or marry & if my said wife shall again marry then my property to be appraised & divided by three disinterested & good citizens & the division to be made by them & after her death my said property to be divided & appraised in like manner without any order of court as I desire to save expenses & the said children in the event my shall so many [ extra words ?] shall have as their Guardian James B. Yarbrough sign, seal, and heard him declare & publish the within writing to be and contain his last Will and Testament, and at the same time thereof he was of sound disposing mind and memory, and that he did it freely without compulsion to the best of my knowledge and belief and that I signed said will in the presence of said John A. Yarbrough at his request and that I saw S. T. Doyal, Aaron D. Nunnaly and E. W. Hammond the other three witnesses sign the same as witnesses in the presence of Testator and in the presence of each other on the day it purports to have been executed John D. He was married to Mary A. Foster on 29 Nov 1855 in Spalding County. She was a daughter of Robert K. Foster and Patience H. Gilder. Mary was born 13 Mar 1840 and died 16 Aug 1908. They are both buried in the Bethany Church Cemetery in Spalding County.
