Vol., commanded by Capt. E.B. West and was honorably discharged at Huntsville, Ala on or about the 20th day of October 1865 by reason of The Surrender. That his personal description (currently) is as follows: age 34 years, height 6 feet, complexion dark, hair auburn, eyes blue. That while a member of the organization aforesaid, in the service, in the line of duty on a march to Richmond in the State of Virginia, on or about April 1865, he contracted disease of the lungs and disease of the kidneys from exposure and hard marching. That he was treated in hospitals as follows: Huntsville, Alabama April 1865. That since leaving the service this applicant has resided in the towns of Ashland in Clay, Ala and Wedowee in Randolph County in the state of Alabama, and his occupation has been that of a farmer and laborer. That prior to his entry into the service above named, he was a man of good, sound, physical health, being when enrolled a farmer. That he is now in part disabled from obtaining his subsistence by manual labor by reason of his above injuries described, received in the service of the United States, and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. White March 1882 Examining Surgeon's Certificate State of Alabama, County of Clay, Ashland Post Office area " In my opinion, the said Andrew McKleroy is partially, say one half, incapacitated for obtaining his subsistence by manual labor from the cause of weakness in the lumber region, chronic nephritis. Judging from his present condition and from the evidence before me it is my belief that the said disability did or may have orginated in the service in the line of duty. I have to rely on his own statements. A more particular description of the applicant's condition is subjoined: Height Six Feet, Weight 150, Complexion Dark, Age 36. Natural signs of the disease chronic nephritis noted; enlargement in lumbar region and left kidney , deep seated pain experienced on pressure over the region of the left kidney; irregularity in the excretion of urine and generally highly colored. Some numbness in the left thigh. While he shows marked weakness in the lungs in conversation and weak sensation about the heart, possibly the result of nervous disturtance or excitement. Signed, J.C. McLeroy, a private of Company B 1st Regiment Ala Cav Volunteers was enrolled on the 1st day of August 1864 at Wedowee for one year and is reported on roll for July and August 64 to present and so reported to February 28, '65. Was taken captured by the enemy at Monroe's Cross Roads N.C. March 10, 1865. Co. was in action at that place and date. June 30, '65 to Aug 21, '65 prresent. Mustered out with Co. Oct 20, 1865. Prisoner of War Records show him captured at Fayetteville N.C. Mar 10, 1865. Paroled at Boulevare and Coxe's Wharf, VA March 30, 1865. Reported at College Green Ohio Md, March 31, 1865, sent to Camp Chase Ohio April 2, 1865 where he arrived April 5, '65. Furloughed April 9, 1865 for 30 days, reported to Reg't May 21, 1865. No certain file extending furlough. B. Barlex ?, Assistant Adjutant General Sept 19, 1887 Claim rejected due to failing to provide the necessary evidence in it's support. Oct 12, 1892 State of Alabama, County of Randolph Declaration for Invalid Pension Personally appeared, Andrew J. McKleroy, aged 46 years, a resident of Gadsden, county of Etowah, State of Alabama, who being duly sworn, declares that he is the identical Andrew J. McKleroy who enrolled on the 1st day of September 1864 in Company B 1st Ala Cav. as a Private, in the War of the Rebellion and served at least ninety days and was honorably discharged at Huntsville, Alabama on the 20th day of October 1865 by reason of disease of the kidneys, disease of the stomach and heart disease. That he makes this declaration for the purpose of being placed on the pension rolls of the United States. He hereby appoints M.V. Tierney of Washington, D.C. as his true and lawful attorney. Liddell, M.D., of Polk County, Georgia State of Georgia, County of Polk Personally appeared, J.A. Liddell, M.D., a citizen of Polk Co., Georgia whose post office address is Cedartown, who being duly sworn, declares: that he is a practicing physician and has been acquainted with the said soldier for one day, and that: I have first examined him to find that he has a chorinic pleuritis with enlargement of the right side with extensive adhesions that must render it almost impossible for him to get about or attend to any business. He also has a choronic cystitis that has existed for 3 or 4 years. Both of which disease must take him the greater part of his time patching up and trying to keep out of bed. These facts are in my own handwriting and not taken from any memoranda or dictated. Signed, J.A. Liddell, M.D. April 26, 1894 General Affadavit of Andrew J. Mcelroy State of Georgia, County of Polk Personally appeared, Andrew J. McKleroy, who being duly sworn, says: the accident which caused some of these troubles took place about four years ago at Borden Springs in Alabama. I went up in a loft to get some fodder and slipped and fell and fell upon a buggy shaft the point of which struck me in the right side; from the effects of this I was laid up and not able to do anything at all for four or five months and have not been able to work ever since. That John Huchings of Cedartown Georgia wrote all of this my affadavit, and Joel Br Brewer ordinary of said county is writing this the latter part from my dictation. Moore of Cedartown, Polk County, Georgia Personally appeared, G.W. Moore, aged 51 years, a resident of Georgia whose post office address is Cedartown, Polk County, GA and J.C. Moore, aged 28 years, a resident of the county of Polk, state of Georgia whose post office address is Cedartown, GA, who each declare and say: That G.W.T. Moore says that he has known Andrew J. McKleroy ever since the year 1868 and has known him continuously since that date to the present time. Andrew J. McKleroy from his appearance and actions has not been able to perform manual labor at any time since 1868 to the present date, nor has he been able to perform manual labor since 1892 to this date. I have seen him begin several crops during this time and break down and fail to make a crop, he could not do more than a half day's work at any time before he would break down and not be able to go. He complains of his side and is said to have cystiitis and pleuritic effusion of the side, as to what his trouble is I am not sure as I am not a physician, but he cannot perform manual labor. J.E. Moore says: I have known Andrew J. McKleroy at least fifteen years. Since I have known him he has not been able to perform manual labor not has he been able since 1892. I have known him a number of times to make efforts to work but could not. He complained of his side. Both of the affiants say that these affadavits were written by F.A. Irvin of Cedartown, Polk County, Georgia from dictation made from memory without memoranda or written statement or dictation from any one whatsoever. G.W. Moore, J.E. Moore Sept 17, 1894 General Affadavit of Andrew J. McKleroy State of Georgia, County of Polk Personally appeared, Andrew J. McKleroy, aged 47 years, a resident of Cedartown, in the county of Polk, State of GA, who being duly sworn, says: that he received the injuries which have disabled him as shown in the previously filed affidavits in this case, and there were no other persons present except Thomas J. Rowe and Dr. Jno. Roberson. Dr. Roberson has been dead for some years and Thomas J. Rowe left this section of the country some months ago and went West and affiant does not now where he has located. This affadavit is written at Cedartown, Georgia on above date written by W.C. B ??? from my own verbal statements and these statements are made by me and are not aided or prompted by any wrotten or printed statement or recital prepared or dictated, by any other person and are made by me from my own knowledge. McKleroy, aged 52 years, a citizen of Cedartown, County of Polk, State of Georgia, who being duly sworn says: Deponent says he never did any service in the Confederate cause except that he was pressed in to service as a home guard when he only remained for a short time until he could find opportunity to make his escape and join the Federal Army, where he remained for 15 months and dif faithful service. McKleroy aged 55 years, a resident of the County of Polk, State of Georgia, whose post office address is Cedartown, Georgia, who being duly sworn according to law, declares: that he is a pensioner under pension No. 438549 on account of the following disabilities: kisease of kidneys, stomach and heart; he further declares that in addition to the said disabilities hereto alleged, he is unable to earn a support by manual labor on account of Rheumatism and General Debility; that he makes this declaration for the purpose of being placed on the pension rolls of the United States under the provisions of the Act of June 27, 1890 and all amendments thereto, and joint resolution approved July 1, 1902. He therefore requests that this supplental declaration be accepted as a part of his Original Claim and considered in connection therewith. Said Company being organized for the purpose of arresting deserters. That his service consisted of arresting deserters. December 1903 Phsician's Affadavit State of Georgia, County of Polk Personally appeared, Jno. J. Cooper, a citizen of Polk County, in the State of Georgia, whose post office address is Cedartown, Georgia, who deposes and says: That he is a practicing physician and that he has been acquainted with the soldier for about 4 years, and that the soldier has Rheumtism of the left arm and shoulder which greatly impairs his strength on the lft side; he is also suffering from a general weakness of the system; he likely has tuberculosis as several of his immediate family has died of the disease. I don't think that he is able to earn a support for himself. I think the applicant is disabled to the extent of three fourths (3/4) of his natural strength. Signed, John J. McKleroy, who being duly sworn, deposes and says: that he is age 65 years and a resident of Cedartown, County of Polk, State of Georgia, that his personal description is as follows: Height 5 feet 9 inches, complexion light, color of eyes blue, color of hair light; that his occupation was farming; that he was born on Sept 10, 1847 at Carroll County, Georgia; that since leaving the service, his places of residence have been: Wedowee, Ala., Arbechoochie, Ala; Ashland, Ala ; for 17 years Cedartown, Georgia has been my post office. McKleroy who after being duly sworn, does declare under oath: that he was born on the 10th day of September 1847 in Carroll County, Georgia. Deponent says that he knows of no public church or famly record of his birth; Deponent says that the family bible in which his age was recorded was destroyed in Randolph County, Alabama about five years ago when his brother's house burned and all it's contents. This family bible so destroyed by fire deponent says was the only record that he has any knowledge of that was ever made of his birth. McKelroy who served as a private in Co. B 1st Alabama Volunteer Cavalry and who was a pensioner under certificate no. 1063671, on the roll of the Pension Agency at Knoxville, Tenn.; that the last payment of his pension was made to the 4th of February 1915, and that he died on 18th day of April 1915. That she was married to the said soldier under the name of Henrietta Jacobs at Cedartown, Georgia on the 11th day of August 1894 by Rev. J.R. King; that she had not been previously married; that the soldier had been previously married to Sallie Harlin who died in Gadsden, Alabama Aug 1890. Tison, Lemuel Johnson June 19, 1915 Declaration for pension for Children under SIxteen Years of Age: State of Georgia, County of Polk Personally appeared, Henrietta McKelroy, aged 40 years, a resident of Cedartown, County of Polk, State of Georgia, who being duly sworn, declares: that she is the mother and next friend of Eve Inex McKelroy, Etta Estella McKelroy and Myrtle Ethel May McKelroy, legitimate children of Andrew Jackson McKelroy. That the mother of said children was married under the name of Henrietta (or Etta) Jacobs at Cedartown, Georgia on the 11th day of August 1894 by Rev. J.R. King. That the soldier has been previously married to Sallie Harlin who died in Gadsden, Ala Aug 1890. That the said soldier died on April 18, 1915 at Cdartown, GA. Lane January 15, 1917 Declaration for Widow's Pension State of Georgia, County of Polk Personally appeared, Etta McKelroy, who being duly sworn, declares: that she is 43 years of age having been born on or about the 15th day of March 1874 at Newnan, Georgia; that she is the widow of Andrew J. McKelroy who died on the 18th day of April 1915. That the names and dates of birth of all the children of the soldier now living and under sixteen years of age are as follows: Eva McKelroy born July 3, 1903; Stella McKelroy born January 30, 1908; and Myrtle McKelroy born Sept 18, 1911. Tison, M.D., aged 46 years, who being duly sworn says: That Andrew J. McKelroy died on the 18th day of April 1915, that the immediate cause of his death was pneumonia; that deponent attended the said Andrew J. McKelroy as his physician during his last illness and death and knows by his personal knowledge the cause and date of death of the said soldier. Deponent further states that he has been a licensed and practicing physician for more than twenty years and has practiced medicine in Polk County for the past fifteen years. Sgiend, W.W. Tison, M.D. June 30, 1917 Affadavit of R.L. Locke State of Georgia, County of Polk Personally appeared, R. L. Locke, aged 49 years, whose post office is Cedartown in the County of Polk, State of Georgia, who being duly sworn, declares: Affiant is well acquainted with claimant and also was well acquainted with her deceased husband Andrew J. McKelroy during his life and knows of his knowledge that the said Etta McKelroy and Andrew J. McKelroy lived together as husband and wife until the death of Andrew J. McKelroy. Affiant says further that he has known claimant and her deceased husband Andrew J. McKelroy for more than twenty years, and was intimately associated with them being their pastor at the time of the death of the said Andrew J. McKelroy, and for fifteen years prior to his death; that during said time he frequently saw them and visited them in their home frequently, the said Andrew McKelroy being a Deacon in affiant's church until his death. Crumbly, age ___ years, whose P.O. is Cedartown, Georgia who says: Deponent says that she is well acquainted with Etta McKelroy, widow of Andrew J. McKelroy, deceased, and has known the said Etta McKelroy since she was a girl ten or twelve years of age. Deponent says that she has lived in the same vicinity with the said Etta McKelroy and saw her very frequently and knows that she never was married until her marriage to Andrew J. McKelroy. Deponent says that Etta McKelroy whose maiden name was Etta Jacobs lived prior to her said marriage just across the street from deponent and that she saw the said Etta Jacobs almost daily before her married to the said soldier. Wilson August 7, 1917 Affadavit of Mrs. Mary Lane State of Georgia, County of Polk Personally appeared, Mrs. Mary Lane, age __ years, whose post office is Cedartown, GA, County of Polk, who after being duly sworn declares: deponent says that her maiden name is Mary Jacobs and that she is a sister of the said Etta McKelroy and has known the said Etta McKelroy all of her life. She says that she has lived in the same vicinity and place as the said Etta McKelroy and has seen Etta McKelroy very frequently and being the sister of said Etta McKelroy has known that she has never contracted any marriage other than to the said Andrew J. Epperson, aged 59 years, whose post office is Atlanta, County of Fulton, State of Georgia who being duly sworn, states: Affiant was personally acquainted with Sallie McKelroy, former wife of Andrew J. McKelroy, and whose maiden name was Sallie Harlan. Affiant says that the said Sallie McKelroy is dead and that he was present at the funeral of the said Sallie McKelroy and viewed her boy after death. Affiant says that the said Sallie McKelroy died on the __day of ___in the year___and that she was buried in the City of Gadsden, State of Alabama. " I was present at the death and funeral of Mrs. Salley McKelroy but an mot sure of the date and whether it was 1890 or 1891. Mr. T.J. Rowe of Birmingham, Ala might remember the exact date." Epperson August 22, 1917 Affadavit of Reuben Golie Lane State of Georgia, County of Polk Personally appeared, Reuben Golie Lane, aged 61 years, whose P.O. is Cedartown, County of Polk,State of Georgia who after being duly sworn, says as follows: Affiant says that he was well acquainted with Sallie McKelroy who before her marriage to Andrew J. McKelroy was Sallie Harlan, and was present at her funeral which was held in the City of Gadsden, Alabama. Affiant says that he viewed the copse or remains after her death and saw her buried in the City of Gadsden. Tison, aged 46 years, whose post office is Cedartown, County of Polk, State of Georgia, who after being duly sworn says: Affiant says that he is a licensed practicing physician and has been engated in the practice of medicine in Polk County, Georgia for the last fifteen years; that he attended Etta McKelroy, now the widow of Andrew J. McKelroy, at the time of the birth of the following children of Etta McKelroy and Andrew J. McKelroy to wit: Eva Inez McKelroy who was born on the 3rd day of July 1903, and who is now fourteen years of age; Etta Estelle McKelroy who was born on the 30th day of January 1908 and who is now nine years of age, and Myrtle Ethel May McKelroy was was born on the 18th day of September 1911 and who is now six years of age. Affiant says that he has been personally acquainted with the said widow and said minor children and on account of the fact that he attended at the birth of said minors that their ages are correctly stated. Barber, Notary Public, Polk Co., GA Dec 21, 1917 Affadavit of Henrietta McKelroy State of Georgia, County of Polk Personally appeared, Henrietta McKelroy, aged 43 years, whose post office is Box 805, Cedartown, County of Polk, State of Georgia, who after being duly sworn, says: That her current christian name is Henrietta, although she is generally and commonly known as Etta. Affiant further says that she is unable to prove that the death of Andrew J. McKelroy was a result if his service in the army. Affiant says further that Andrew J. McKelroy died on the 18th day of April 1915 from pneumonia. Affiant further states that there are no public records showing the date of the death of the said Andrew J. McKelroy nor are there any records showing the cause of death of the said Andrew J. McKleroy. Affiant says that she is the widow of the said Andrew J. Walker, City Clerk, Cedartown, Georgia Personally appeared, J.C. Walker, aged ___ years, whose post office address is Cedartown, county of Polk, State of Georgia, who being duly sworn, says: Affiant says that he is a Clerk of City of Cedartown and as such official is the custodian of the public records of said City. Affiant says that he has made search of the records in his office and that there are no records of deaths for the year 1915 in his office. Signed, J.C. Walker, City Clerk August 8, 1918 Declarion for Children Under Sixteen Years of Age State of Georgia, County of Polk Personally appeared, Belle Blankenship, aged thirty three years, who being duly sworn, makes the following declaration: That she is the next friend of below named minors, the legitimate children of Andrew J. McKelroy, deceased, and Etta McKelroy, who died June 3, 1918. That the names and dates of birth of all the surviving children of the soldier and widow are as follows: Eva McKelroy born July 3, 1903 Stella McKelroy born January 30, 1908 Myrtle McKelroy born September 18, 1911. Crawford State of Georgia, County of Polk Personally appeared, W.W. Crawford, aged ___ years, who being duly sworn says: Deponent says on oath that he is the Ordinary of Polk County, Georgia and as such official has charge of the estates, the probate of wills, the granting of administrations and all matters pertaining to the esteates of deceased persons. Deponent further says that there are no record of births or deaths kept in his office and that under the laws of the State of Georgia, no public records of deaths are recorded in any office in said county or state. Deponent further states that at the time of the death of Henrietta McKelroy he acted and officiated as the Undertaker and as such undertaker had charge of the boy and the burial of the said Henrietta McKelroy. Deponent says that Henrietta McKelroy died on the 3rd day of June 1918. Signed, W.W. Crawford Nov 12, 1919 Affadavit of G.W. T. Moore of Paulding County, Georgia State of Georgia, County of Polk Personally appeared, G.W. T. Moore, aged 77 years, whose post office is Dallas, County of Paulding, State of Georgia, who being duly sworn, states as follows: Deponent says that he knew Andrew J. McKelroy during his life; that he became acquainted with him a year or two after the War " between the sections",; that at the time he became acquainted with the said Andrew J. McKleroy he was residing in Tallapoosa County, Alabama sometime before the year 1870; deponent says that he was well acquainted with the first wife of Andrew J. McKelroy; that her maiden name was Sallie Hardin and that she died while they were residing in the state of Alabama; that after the death of the said Sallie Hardin, McKelroy, the said Andrew J. McKelroy married Julia Brown,, with whom he lived as man and wife for about two years, when the said Julia Brown McKelroy died and was buried in the City of Cedartown, Georgia. Deponent says further that after the death of the said Julia Brown McKelroy, that one child was born of said marriage but died in infancy. Deponent says further that after the death of the said Julia Brown McKelroy, the said Andrew J. McKelroy contracted marriage with Etta Jacobs with whom he lived until his death. Deponent was well acquainted with the said Andrew McKelroy, saw him frequently and was often in his company and in his home. Deponent says that the said Andrew J. McKelroy did not contract any other marriage than those named in this affadavit, that he was well acquainted with him from a year or two after the War between the States until the time of his death. Deponent says he assisted in preparing the second wife of Andrew J. McKelroy (Julia Brown McKelroy) for burial. Deponent lived within a few miles of the said McKelroy during his residence in Alabama and also within a few miles of him after he removed to his residence in Georgia. Signed, G.W. T. May 1, 1920 Affadavit of Callie Ragsdale State of Georgia, County of Polk Personally appeared, Callie Ragsdale, aged 46 years, whose post office is Cedartown, County of Polk, State of Georgia, who after being duly sworn, says: That deponent is well acquainted with the children of Andrew J. McKleroy and that Eva McKlelroy, Stella McKelroy and Myrtle McKleroy are the minor children of Andrew J. McKelroy and Henrietta McKelroy. Deponent was also well acquainted with the second wife of the said Andrew J. McKelroy, namely Julia Browne McKelroy and visited her during her last illness. Deponent says that the said Julia Browne McKelroy died the last of September 1892. Deponent remembers the time of the death of the said Julia Browne McKelroy because she remembers that she died in the Fall an in the month of September before the death of depondents father Z.T. Ragsdale who died April 8, 1893. Deponent says that her father Z.T. Ragsdale was buried at the same cemetery lot where Julia Browne McKelroy was buried and that when deponent's father was buried, the said Julia Browne McKelroy had been buried on said lot about six months; that thereafter said lot was purchased by depondents famnily and the body of said Julia Browne McKelroy removed therefrom to another lot. Deponent says further that after the death of the said Julia Browne McKelroy, Andrew J. McKelroy moved near to where deponent lived and that she saw him and his family frequently. Blankenship and Martha Blankenship State of Georgia, County of Polk In the matter of the Belle Blankenship, guardian of the minor children of Andrew J. McKelroy; Personally appeared, Martha Blankenship, aged 78 years whose post office address is Cedartown, Polk Co., GA, and J. H. Blankenship, aged 60 years whose post office address is Cedartown, Polk Co., GA, who after being duly sworn do say: That affiant Martha Blankenship is the grandmother of Charlie Blankenship, and the mother of the affiant J.H. Blankenship; that J.H. Blankenship is the father of Charlie Blankenship. Affiants say that Charlies Blankenship was born on the 20th (?) day of November 1894 (?) and that the said Charlies Blankenship is now twenty five years of age. Affiants say that they were present when the said Charlie Blankenship was born and know that his age is correctly stated. Affiants state that there are no public records shwoing the date of birth of the said Charlies Blankenship's birth. Affiants say that the said Charlie Blankenship is the husband Eva Blankenship, formerly Eva McKelroy, the eldest of the minor children of the said Andrew J. McKelroy.
