I Joel Adkins of Said state and County being of advanced age but of sound and disposing mind and memory knowing that I must shortly depart this life deem it right and proper both as respects my family and myself that I should make a disposition of the property with which a kind providence has blessed me. I do therefor make this my last will and testament hereby revoking and annulling all others by me heretofore made. Item 1st: I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life. My soul I trust shall return to rest with God who gave it as I hope for salvation through the merits and atonement of the blessed Lord and Savior Jesus Christ. Item 2nd: I desire and direct that all my just debts be paid without delay by my Executor hereinafter named and appointed. Item 3rd: I give and bequeath to by beloved wife Mary, one undivided half interest in lot of land number (one) in block L. fronting Marble Street in the town of Rockmont in Polk County Georgia with all the rights, members and appertains in anywise belonging to said interest free from all charge and ____ whatever to her own proper use, benefit and behalf forever with full power to dispose of the same by will or otherwise as she may deem proper. I also give and bequeath to my beloved wife in the same unreserved manner all of my household and. kitchen furniture and all of the seed grown or growing during the present year on lots of land numbers 1050, 1051, 1022, 1023, & 1097 in the 21st district and 3rd section in Polk County Georgia and the property devised and bequeathed in the above articles to my wife is in full extinguishment of her whole right of Dower in my real estate. Item 4th: I give and bequeath to my daughter Elizabeth C. Mull wife of Thomas Mull one undivided half interest in lot land number (one) in block L. fronting Marble Street in the town of Rockmont in Polk County Georgia with all the rights, members and appertains in anywise belonging to said interest whatever to her own proper use, benefit and behalf forever with full power to dispose of the same by will or otherwise as she may deem proper, free from the debts & liabilities of her husband. Item 5th: I give and bequeath to my daughter Mary Ann Waddell wife of Alfred Waddell, lot of land number 1048 one thousand and forty eight in the 21st district and 3rd section in Polk County Georgia containing 40 acres more or less. With all the rights, members and appertains in anywise belonging thereto to her own proper use, benefit and behalf forever. With full power to dispose of the same by will or otherwise as she may deem proper, free from the debts and liabilities of her husband. Item 6th: I desire and direct that my Executor hereinafter named shall sell the residuum of my real and personal property except the crop grown and growing during the present year on lot number 1046 in the 21st district and 3rd section in Polk County Georgia. This crop I give and bequeath to my said son Joel Atkins and in addition to said crop I give and bequeath one hundred and fifty dollars to be paid to him out of my estate by my Executor for improvements made on said lot by my said son. I also give and bequeath to my son Joel A. Adkins one hundred and sixty dollars to be paid to him by my Executor out of the proceeds of the sale of my real and personal estate. Item 7th: I desire and direct that my Executor sell the remainder of my property not already bequeathed either at public or private sale as he may think will be to the interest of the beneficiaries under this will. Item 8th: It is my desire that my son James A. Adkins is not to pay any interest on a note given me by him for lot of land number 1173 in the 21st district & 3rd section in Polk County Georgia. Said note being for two hundred and sixty five dollars. Item 9th: I desire and direct that my Executor pay to the persons hereinafter named the sums to be hereafter stated out of the proceeds of the sale of my real and personal estate as follows. To my son Jepetha V. Adkins one hundred and seventy dollars. To my son James A. Adkins one hundred and twenty dollars. To my son George M. Adkins one hundred and seventy dollars. To my son Milus Adkins one hundred and fifty five dollars. To my son Wyatt Adkins one hundred and nineteen dollars. To my daughter Nancy C. Shewmate one hundred and thirty dollars. To each of my gran daughters to wit Sallie Waddell, Mary Ella McRae and Wouitha Adkins daughters of Nathaniel M. Adkins forty dollars. To my daughter Irena Agan one hundred and seventy dollars. It is my desire that the amounts given and bequeath in the foregoing articles to my daughters and grand daughters shall be free and exempt from the debts and liabilities of the husbands of such daughters and grand daughters in each case where they have a husband. Item 10th: I desire and direct that after the legacies heretofore named have been paid if there be any money left of the proceeds of the sale of my property by the collection of my debts or otherwise, that my Executor divide the sum share and share alike between my sons Jepetha V., Joel A., James A., George M., Milus, Wyatt, my daughters Nancy C., Irena Ann, Mary Ann, & my grand daughters Sallie Waddell, Mary Ella McRae and Wouitha Adkins, daughters of Nathaniel M. Adkins with this exception said grand daughters are only to have the same amount to be divided between them that one of my sons or daughters may have. Item 11th: I hereby constitute and appoint my son James A. Adkins Executor of this my last will and testament this 19th day of July 1876. his Joel X Adkins mark Signed, sealed, declared and published by Joel Adkins as his last will and testament in the presence of us the undersigned who subscribed our names thereto in the presence of said testator at his special instance and request and in presence of each other this July 19th 1876.
