Newman 1911," Georgia State Archives. State of Georgia, County of Pulaski To the Ordinary of said county: The petition of James W. Newman respectfully shows that he is a resident of said state; the Mrs. Mollie E. Newman died intestate on or about the [blank] day of [blank] 1900, a resident of said state and county, owning at the time of her death property ion said state of the probable value of Two Thousand dollars; that in order to pay the debts of said estate and to make distribution of her property among the heirs and administration is necessary; that the petitioner is a son of said deceased. Wherefore your petitioner prays citation may issue a[s?] usual, calling upon all interested to show cause, if any they can, at the next term of the court of Ordinary of said county, why letters of administration on said estate should not be granted to our petitioner. McGriff Ordinary ******** Georgia - Pulaski County And now comes Elmira Bruce, and files this her caveat to the application of James W. Newman for the appointment of permanent administrator upon the estate of Mrs. Mollie E. Newman, and for ground of objection says: 1. Because the estate of Mrs. Mollie E. Newman owed no debts. 2. Because the estate of said Mrs. Newman consisted entirely of 100 acres of land, same being the West half of lot #268 in the 4th land district of Pulaski county, Georgia. 3. Decedent departed this life in the year 1900, the day and month of which is not rememberd (sic), leaving as her sole surviving herirs (sic) at law, her husband, Abe Newman, W. A. Newman, James W. Newman, Johnnie Newman and Mary Lou Newman, to whom the above described property descended directly, there bing (sic) no debts of the decedent. 4. 4th. Abe Newman, the husband of decedent departed this life about one year after the death of Mrs. Mollie Newman, and his death left the remaining herirs (sic) interested in the property above described to the extent of one-fourth each. 5. That all of said heirs are of age, and there is no necessity for an administration for the purpose of distribution. 6. That two shares of the estate, consisting of a one-fourth interest each in the 100 acres of land above referred to, which was the interest of W. A. Newman and James W. Newman, have been purchased by caveator, and caveator has the same interest in said estate that W. A. Newman and J. W. Newman had and the same right to object to the appointment of an administrator as either of said heirs had. 7. Caveator avers that the 100 acres above referred to has been divided between her and the two other heirs to-wit: Johnnie Newman and Mary Lou Brogdell (sic), nee Newman, said land being so situated that it could be equitably divided in kind. 8. Caveator further avers that said estate has been equitably divided among the heirs at law of the decedent and there is no necessity ofr (sic) an administration on said estate, with its attendant expense and the waste that such an administration, useless as it is, would entail on the very small estate left by the decedent. Wherefore caveator prays that these her grounds of objection be inquired into and that said application for administration be refused. Howard E. Coates Attorney for Caveator ***** Pulaski Court of Ordinary, July Term, 1911 Ciatation (sic) having been duly issued and published, requiring all and singular the next of kin and creditors of Mrs. Mollie E. Newman, deceased, late of said county, to appear at [inserted above: the last] term, [inserted above: & having been continued till now], and show cause, if any they could, why permanent letters of administration should not be granted to James W. Newman, and the parties so notified making no valid objection thereto, it is after considering the same, ordered by the court that letters of administration issue to R. F. Daniel as administrator upon the estate of the said deceased, upon his giving bond and security in the sum of One thousand dollars, and taking the usual oath of office. So ordered this 3rd July 1911. P.T. McGriff Ordinary ***** Georgia - Pulaski County To the Honorable P. T. McGriff, Ordinary of said County: The petition of R. F. Daniel, as Administrator of the estate of Mrs. Molly (sic) E. Newman, respectfully represents that in order to pay the debts of said estate and to make distribution among the heirs thereof, it is necessary to sell all of the real estate belonging to said estate. Wherefore, he prays that citation may issue calling on all parties to show cause why an order to this effect should not be granted and that after same has been published for the time required by law, that your Honor will pass an order allowing him to sell said real estate for the purposes herein before stated. Tho? Warren Grice Petitioners Attorney Ordered that citation issue and be published on the above as prayed for. This 5th July, 1911. P. T. McGriff Ordinary Additional Comments: Mary Elizabeth "Mollie" Conner was born in Pulaski County on 25 Mar 1853, the daughter of William D. and Lucinda (Vass) Conner. She married Abraham William "Abe" Newman on 11 Jun 1872 in Pulaski. Mollie died on 17 July 1900 from typhoid fever. Abe was admitted to the Confederate Soldiers' Home in Atlanta, Georgia, on 3 Jun 1901, one of the first 40 vets to move into this new facility. When the home burned in October 1901, the residents were moved to a "temporary" facility, where Abe died on 27 Aug 1902. By the time of the above petition, William A. Newman, Abe and Mollie's eldest son, had died, in 1906, after having been struck by lightning. Abe and Mollie's daughter, Mary Lou (probably named for her maternal grandmother, Lucinda Vass), was married to Fritz Fleda Brogdon, not Brogdell.
