Witnesseth that whereas by virtue of an order granted by the Honorable the Inferior Court of Morgan County when sitting for ordinary purposes for said County on the fifth day of March eighteen hundred & thirty two to the said George L. Bird to sell the following described land situate lying & being in the County and state first aforesaid on the waters of Glady Creek it being part of lot number one hundred & five and that part of the said lot square off adjoining Youngbloods Tompkins Ogletrees & others containing fifty acres more or less and after the same was duly advertised in one of the public Gazetts of this State & in conformity to the law the same was put up and exposed to sale to the highest bidder at the door of the courthouse of said county within the legal hours of sale on the first Tuesday in March eighteen hundred & thirty two by the said George L Bird Guardian as aforesaid when the same was knocked off to the said Nicholas Tompkins at the price or sum of three hundred and fifty 100 dollars he being the highest bidder Now for and in consideration of the said sum of three hundred dollars & fifty cents in hand paid to him the said George L Bird Guardian as aforesaid by the said Nicholas Tompkins at and before the signing & sealing & delivery of these presents the receipt whereof is hereby acknowledged; he the said George L Bird Guardian as aforesaid hath granted bargained and sold and by these presents doth grant bargain & sell unto him the said Nicholas Tompkins the before named bargained land With all the improvements & appertenances thereunto belonging or in any wise appertaining unto him the said Nicholas Tompkins and his heirs & assigns to his & their own proper use benefit & behoof forever in fee simple and the said George L Bird Guard. as aforesaid the before Named with all the improvements & appertenances thereunto belonging or in any wise appertaining unto the said Nicholas Tompkins and his heirs & assigns shall and will warrant & forever defend the legal and equitable title against himself & all and every other person or persons whatever as far as in law & equity he may be bound to do as Guardian as aforesaid. In Witness whereof the said George L Bird Guardian as aforesaid hath hereunto set his hand & affixed his seal the day and date before written Signed Sealed & delivered in presence of J B Ghent George L Bird Guard William Peek Georgia } Whereas George L Bird by deed from Fanny Morgan County } Price holds the rights to the above named fifty acres of land. This certifies that I hereby relinquish all right title or interest which I have in said land unto the said Nicholas Tompkins his heirs and assigns forever against me & my heirs & assigns will warrant & forever defend by virtue of these presents In testimony whereof I have hereunto set my hand and seal the 8th day of September 1832 In presence of J B Ghent George L.
